{"data":{"id":"us-nm/66-8-122","jurisdiction":"us-nm","citation":"66-8-122","heading":"Immediate appearance before magistrate.","body":"Whenever any person is arrested for any violation of the Motor Vehicle Code [66-1-1 NMSA 1978] or other law relating to motor vehicles punishable as a misdemeanor, he shall be immediately taken before an available magistrate who has jurisdiction of the offense when the:\nA. person requests immediate appearance;\nB. person is charged with driving while under the influence of intoxicating liquor or narcotic drugs;\nC. person is charged with failure to stop in the event of an accident causing death, personal injuries or damage to property;\nD. person is charged with reckless driving;\nE. arresting officer has good cause to believe the person arrested has committed a felony;\nF. person refuses to give his written promise to appear in court or acknowledge receipt of a warning notice; or\nG. person is charged with driving when his privilege to do so was suspended or revoked pursuant to Section 66-8-111 NMSA 1978 or pursuant to a conviction for driving while under the influence of intoxicating liquor or drugs.","path":["Chapter 66 - Motor Vehicles","ARTICLE 8 Crimes, Penalties and Procedure"],"source_url":"https://nmonesource.com/nmos/nmsa-unanno/en/item/18569/index.do","current_through":"2026-07-01","vintage":"","retrieved_at":"2026-09-03T15:02:20Z","sha256":"5749f79a177582ed69b18daeac96332095a4b69c48fbcbe89c9bbcbd3900d968","source_id":"us-nm","stale":false,"prev":"us-nm/66-8-121","next":"us-nm/66-8-123"},"notice":"GroundRules: Original legal text.
