A member of the Armed Forces of the United States, a reserve component thereof or the National Guard may, by written instrument and without the approval of a court, appoint any adult residing in this State who is not incapacitated as the guardian of the person of a minor child who is a dependent of that member. The instrument must be:\n(a) Executed by both parents if living, not divorced and having legal custody of the child, otherwise by the parent having legal custody; and\n(b) Acknowledged in the same manner as a deed.\nÊ If both parents do not execute the instrument, the executing parent shall send by certified mail, return receipt requested, to the other parent at his or her last known address, a copy of the instrument and a notice of the provisions of subsection 3.\n2. The instrument must contain a provision setting forth the:\n(a) Branch of the Armed Forces;\n(b) Unit of current assignment;\n(c) Current rank or grade; and\n(d) Social security number or service number,\nÊ of the parent who is the member.\n3.
