Except as otherwise provided in subsection 3, a city council or other governing body of an incorporated city shall enact ordinances regulating battery-charged fences.\n2. An ordinance enacted pursuant to this section must, without limitation, require that a battery-charged fence:\n(a) Be located on property that:\n(1) Is not designated for residential use; or\n(2) Is designated for residential use and:\n(I) Is located in a rural zoning area; or\n(II) Is governed by the provisions of NRS 278.780 to 278.828, inclusive;\n(b) Use a battery that is not more than 12 volts of direct current;\n(c) Have an energizer that meets the most current standards set forth by the International Electrotechnical Commission;\n(d) Be surrounded by a nonelectric perimeter fence or wall that is at least 5 feet in height;\n(e) Not be higher than 10 feet in height or 2 feet higher than the height of the nonelectric perimeter fence or wall described in paragraph (d), whichever is greater; and\n(f) Be marked with conspicuous warning signs that are located on the battery-charged fence at intervals of not more than 40 feet and that read: “WARNING: ELECTRIC FENCE.”\n3. A city council or other governing body of an incorporated city, in enacting an ordinance pursuant to this section, may not enact an ordinance that:\n(a) Requires a permit for the installation or use of a battery-charged fence that is in addition to any permit that is required to install an alarm system;\n(b) Imposes any installation or operational requirement for a battery-charged fence that is inconsistent with the most current standards set forth by the International Electrotechnical Commission; or\n(c) Prohibits the installation or use of a battery-charged fence.\n4. As used in this section:\n(a) “Alarm system” means a device or system that transmits an audible, visual or electronic signal intended to summon or alert law enforcement.
