{"data":{"id":"us-nv/nrs-281a.160","jurisdiction":"us-nv","citation":"NRS 281A.160","heading":"“Public officer” defined.","body":"1. “Public officer” means a person who is:\n(a) Elected or appointed to a position which:\n(1) Is established by the Constitution of the State of Nevada, a statute of this State or a charter or ordinance of any county, city or other political subdivision; and\n(2) Involves the exercise of a public power, trust or duty; or\n(b) Designated as a public officer for the purposes of this chapter pursuant to NRS 281A.182.\n2. As used in this section, “the exercise of a public power, trust or duty” means:\n(a) Actions taken in an official capacity which involve a substantial and material exercise of administrative discretion in the formulation of public policy;\n(b) The expenditure of public money; and\n(c) The administration of laws and rules of the State or any county, city or other political subdivision.\n3. “Public officer” does not include:\n(a) Any justice, judge or other officer of the court system;\n(b) Any member of a board, commission or other body whose function is advisory;\n(c) Any member of a special district whose official duties do not include the formulation of a budget for the district or the authorization of the expenditure of the district’s money; or\n(d) A county health officer appointed pursuant to NRS 439.290.\n4. “Public office” does not include an office held by:\n(a) Any justice, judge or other officer of the court system;\n(b) Any member of a board, commission or other body whose function is advisory;\n(c) Any member of a special district whose official duties do not include the formulation of a budget for the district or the authorization of the expenditure of the district’s money; or\n(d) A county health officer appointed pursuant to NRS 439.290.","path":["TITLE 23 — PUBLIC OFFICERS AND EMPLOYEES","CHAPTER 281A - ETHICS IN GOVERNMENT","GENERAL PROVISIONS"],"source_url":"https://www.leg.state.nv.us/NRS/NRS-281A.html#NRS281ASec160","current_through":"2025 session (NRS as revised 2026-08-25)","vintage":"","retrieved_at":"2026-09-03T05:51:36Z","sha256":"e1bbc8457028fe1247a5a2390ae912c79509436b5e33296c702c165bb3afe2b8","source_id":"us-nv","stale":true,"prev":"us-nv/nrs-281a.150","next":"us-nv/nrs-281a.161"},"notice":"GroundRules: Original legal text.
