{"data":{"id":"us-nv/nrs-38.535","jurisdiction":"us-nv","citation":"NRS 38.535","heading":"Required assessment and disclosures regarding process by prospective collaborative lawyer.","body":"Before a prospective party signs a collaborative law participation agreement, a prospective collaborative lawyer shall:\n1. Assess with the prospective party factors that the lawyer reasonably believes relate to whether a collaborative law process is appropriate for the prospective party’s matter;\n2. Provide the prospective party with information that the lawyer reasonably believes is sufficient for the prospective party to make an informed decision about the material benefits and risks of a collaborative law process as compared to the material benefits and risks of other reasonably available alternatives for resolving the proposed collaborative matter, such as litigation, mediation, arbitration or expert evaluation; and\n3. Advise the prospective party that:\n(a) After a collaborative law participation agreement is signed, the collaborative law process terminates if a party initiates a proceeding or seeks the intervention of a tribunal in a pending proceeding related to the collaborative matter;\n(b) Participation in a collaborative law process is voluntary, and any party has the right to terminate unilaterally a collaborative law process with or without cause; and\n(c) The collaborative lawyer and any lawyer in a law firm with which the collaborative lawyer is associated may not appear before a tribunal to represent a party in a proceeding related to the collaborative matter, except as authorized by subsection 3 of NRS 38.510, subsection 2 of NRS 38.515 or subsection 2 of NRS 38.520.","path":["TITLE 3 — REMEDIES; SPECIAL ACTIONS AND PROCEEDINGS","CHAPTER 38 - MEDIATION AND ARBITRATION","COLLABORATIVE LAW (UNIFORM ACT)"],"source_url":"https://www.leg.state.nv.us/NRS/NRS-038.html#NRS038Sec535","current_through":"2025 session (NRS as revised 2026-08-25)","vintage":"","retrieved_at":"2026-09-03T05:51:30Z","sha256":"11d350cd58ac9c7d4836c8bc1e0c8c29586e3e95eb29963077f9ac3b325abe0d","source_id":"us-nv","stale":true,"prev":"us-nv/nrs-38.530","next":"us-nv/nrs-38.540"},"notice":"GroundRules: Original legal text.
