A behavioral health specialist performing mobile crisis intervention services by telephone or audio-video communication, whether for compensation or gratuitously, is immune from any civil liability in the performance of mobile crisis intervention services if:\n(a) The acts or omissions of the person are in good faith; and\n(b) The acts or omissions of the person do not constitute gross negligence or willful, wanton or intentional misconduct.\n2. As used in this section:\n(a) “Audio-video communication” means communication by which a person is able to see, hear and communicate with another person in real time using electronic means.\n(b) “Behavioral health specialist” means a psychiatrist who is licensed pursuant to chapter 630 or 633 of NRS, a psychologist, a physician assistant or an advanced practice registered nurse who is certified to practice as a behavioral health specialist, or a person who is licensed as a clinical social worker, clinical professional counselor or marriage and family therapist.\n(c) “Mobile crisis intervention services” means services provided under the direction of a peace officer while engaging in an emergency response to assist a person who is experiencing a behavioral health crisis by:\n(1) Stabilizing, de-escalating or resolving the crisis;\n(2) Screening or assessing the person for safety; or\n(3) Creating a safety plan.\n(d) “Peace officer” means any person upon whom some or all of the powers of a peace officer are conferred pursuant to NRS 289.150 to 289.360, inclusive.","path":["TITLE 3 — REMEDIES; SPECIAL ACTIONS AND PROCEEDINGS","CHAPTER 41 - ACTIONS AND PROCEEDINGS IN PARTICULAR CASES CONCERNING PERSONS","LIABILITY OF PERSONS WHO MAKE OR CAUSE TO BE MADE FALSE REPORTS OF CRIMES OR EMERGENCIES"],"source_url":"https://www.leg.state.nv.us/NRS/NRS-041.html#NRS041Sec5075","current_through":"2025 session (NRS as revised 2026-08-25)","vintage":"","retrieved_at":"2026-09-03T05:51:30Z","sha256":"5be1ccaf8eee329417bff094e3655e1322a1f1af050cf2b4324c2274ff4b772a","source_id":"us-nv","stale":true,"prev":"us-nv/nrs-41.507","next":"us-nv/nrs-41.508"},"notice":"GroundRules: Original legal text.
