A child or a parent or legal guardian of the child who opposes a petition to continue an emergency admission pursuant to subsection 2 of NRS 432B.6075 may petition the court to authorize a second examination of any child examined pursuant to subsection 1 of NRS 432B.6075. The court shall authorize a second examination upon receiving such a petition. A second examination must be completed not later than 6 days after the court authorizes the examination.\n2. If the court authorizes a second examination of the child, the examination must:\n(a) Be conducted by a physician, psychiatrist, psychologist or advanced practice registered nurse who has the psychiatric training and experience prescribed by the State Board of Nursing pursuant to NRS 632.120 who is not:\n(1) The same physician, psychiatrist, psychologist or advanced practice registered nurse who completed the certificate pursuant to subsection 1 of NRS 432B.6075 or a physician, psychologist or advanced practice registered nurse who participated in the examination conducted pursuant to that subsection; or\n(2) Employed by, connected to or otherwise affiliated with the facility where the child is admitted;\n(b) Include, without limitation, an evaluation of the diagnosis of the child, whether the child presents a substantial likelihood of serious harm to himself or herself or others, as determined pursuant to NRS 433A.0195, and whether the emergency admission should be continued; and\n(c) Be paid for by the governmental entity that is responsible for the agency which provides child welfare services, if such payment is not otherwise provided by the State Plan for Medicaid.","path":["TITLE 38 — PUBLIC ASSISTANCE","CHAPTER 432B - PROTECTION OF CHILDREN FROM ABUSE AND NEGLECT","COURT-ORDERED ADMISSION OF CERTAIN CHILDREN WITH EMOTIONAL DISTURBANCE TO CERTAIN FACILITIES","Emergency Admission"],"source_url":"https://www.leg.state.nv.us/NRS/NRS-432B.html#NRS432BSec6078","current_through":"2025 session (NRS as revised 2026-08-25)","vintage":"","retrieved_at":"2026-09-03T05:51:39Z","sha256":"36cbc7e69dbe09c2a81046b167796c9bf20c0570d9ce3657c2d692ec10160490","source_id":"us-nv","stale":true,"prev":"us-nv/nrs-432b.6076","next":"us-nv/nrs-432b.6079"},"notice":"GroundRules: Original legal text.
