Except as otherwise provided in subsection 2, if a patient giving birth at a hospital requests the insertion or injection of long-acting reversible contraception, the hospital shall provide for the insertion or injection of the long-acting reversible contraception immediately after the birth unless:\n(a) The use of the long-acting reversible contraception is contraindicated for the patient; or\n(b) A physician, physician assistant or advanced practice registered nurse determines that inserting or injecting the long-acting reversible contraception would create an unreasonable risk of harm to the patient.\n2. A hospital that is affiliated with a religious organization is not required to provide the service described in subsection 1 if the hospital objects on religious grounds. Before scheduling a patient for maternity care or, if such scheduling does not occur, upon admitting a patient to the hospital for maternity care, the hospital shall provide to the patient written notice that the hospital refuses to provide the service required by subsection 1.\n3. A hospital shall not require a provider of health care who objects to the service described in subsection 1 on religious grounds to participate in the provision of that service. If such a provider of health care at a hospital, other than a hospital described in subsection 2, receives a request for that service, the provider shall refer the patient to a provider of health care who is willing to provide the service.\n4. A hospital or provider of health care may not require a third party to pay more for:\n(a) Long-acting reversible contraception inserted or injected pursuant to subsection 1 than the lowest rate prescribed in a contract between the third party and a hospital or a provider of the same type as the provider of health care, as applicable, for the same type of long-acting reversible contraception.\n(b) The insertion or injection of long-acting reversible contraception pursuant to subsection 1 than the lowest rate prescribed in a contract between the third party and a hospital or a provider of the same type as the provider of health care, as applicable, for insertion or injection of the same type of long-acting reversible contraception.\n(c) Any testing associated with the insertion or injection of long-acting reversible contraception pursuant to subsection 1 than the lowest rate prescribed in a contract between the third party and a hospital or a provider of health care of the same type as the provider of health care, as applicable, for the same test.\n5. As used in this section:\n(a) “Long-acting reversible contraception” means a method of contraception that requires administration less than once per month, including, without limitation:\n(1) An intrauterine device;\n(2) A contraceptive implant; and\n(3) An injectable contraceptive.\n(b) “Third party” means:\n(1) An insurer, as that term is defined in NRS 679B.540;\n(2) A health benefit plan, as that term is defined in NRS 687B.470, for employees which provides coverage for prescription drugs;\n(3) A participating public agency, as that term is defined in NRS 287.04052, and any other local governmental agency of the State of Nevada which provides a system of health insurance for the benefit of its officers and employees, and the dependents of officers and employees, pursuant to chapter 287 of NRS; or\n(4) Any other insurer or organization that provides health coverage or benefits in accordance with state or federal law.","path":["TITLE 40 — PUBLIC HEALTH AND SAFETY","CHAPTER 449 - MEDICAL FACILITIES AND OTHER RELATED ENTITIES","LICENSING AND REGULATION","Miscellaneous Provisions"],"source_url":"https://www.leg.state.nv.us/NRS/NRS-449.html#NRS449Sec1822","current_through":"2025 session (NRS as revised 2026-08-25)","vintage":"","retrieved_at":"2026-09-03T05:51:40Z","sha256":"36125791a36db702d237798ff4b2995150505e5ec06ff6839178518e236cb69c","source_id":"us-nv","stale":true,"prev":"us-nv/nrs-449.1821","next":"us-nv/nrs-449.1823"},"notice":"GroundRules: Original legal text.
