It is unlawful for any person to:\n(a) Construct, substantially alter or operate any facility for the management of hazardous waste; or\n(b) Manage any hazardous waste,\nÊ unless the person has first obtained a permit from the Department to do so, if a permit is required for that type of facility for the management of hazardous waste by the regulations adopted by the Commission pursuant to NRS 459.520.\n2. A person who:\n(a) Conducts an activity for which a permit is required pursuant to this section, and is doing so on the effective date of the regulations establishing procedures for the system of permits; and\n(b) Has made an application for a permit,\nÊ shall be deemed to have been issued a permit until his or her application has been acted upon, unless a delay in that action was caused by the person’s failure to furnish information which was reasonably requested or required for the processing of the application.\n3.
