The Board shall:\n(a) Designate one or more of its employees for the investigation of constructional fraud;\n(b) Cooperate with other local, state or federal investigative and law enforcement agencies, and the Attorney General;\n(c) Assist the Attorney General or any official of an investigative or a law enforcement agency of this State, any other state or the Federal Government who requests assistance in investigating any act of constructional fraud; and\n(d) Furnish to those officials any information concerning its investigation or report on any act of constructional fraud.\n2. The Board may obtain records of a law enforcement agency or any other agency that maintains records of criminal history, including, without limitation, records of:\n(a) Arrests;\n(b) Guilty and guilty but mentally ill pleas;\n(c) Sentencing;\n(d) Probation;\n(e) Parole;\n(f) Bail;\n(g) Complaints; and\n(h) Final dispositions,\nÊ for the investigation of constructional fraud.\n3. For the purposes of this section, constructional fraud occurs if a person engaged in construction knowingly:\n(a) Misapplies money under the circumstances described in NRS 205.310;\n(b) Obtains money, property or labor by false pretense as described in NRS 205.380;\n(c) Receives payments and fails to state his or her own true name, or states a false name, contractor’s license number, address or telephone number of the person offering a service;\n(d) Diverts money or commits any act of theft, forgery, fraud or embezzlement, in connection with a construction project, that violates a criminal statute of this State;\n(e) Acts as a contractor without:\n(1) Possessing a contractor’s license issued pursuant to this chapter; or\n(2) Possessing any other license required by this State or a political subdivision of this State;\n(f) In any report relating to a contract for a public work, submits false information concerning a payroll to a public officer or agency; or\n(g) Otherwise fails to disclose a material fact.","path":["TITLE 54 — PROFESSIONS, OCCUPATIONS AND BUSINESSES","CHAPTER 624 - CONTRACTORS","STATE CONTRACTORS’ BOARD"],"source_url":"https://www.leg.state.nv.us/NRS/NRS-624.html#NRS624Sec165","current_through":"2025 session (NRS as revised 2026-08-25)","vintage":"","retrieved_at":"2026-09-03T05:51:44Z","sha256":"a101555028a9f9453531398e78964baef38a2c6483a9b941661af3d1fde4419f","source_id":"us-nv","stale":true,"prev":"us-nv/nrs-624.160","next":"us-nv/nrs-624.170"},"notice":"GroundRules: Original legal text.
