Any person desiring to conduct a school of cosmetology in which any one or any combination of the occupations of cosmetology are taught must apply to the Board for a license, through the owner, manager or person in charge, upon forms prepared and furnished by the Board. Each application must contain proof of the particular requisites for a license provided for in this chapter, and the applicant must certify that all the information contained in the application is truthful and accurate. The forms must be accompanied by:\n(a) A detailed floor plan of the proposed school;\n(b) The name, address and number of the license of the manager or person in charge and of each instructor;\n(c) Evidence of financial ability to provide the facilities and equipment required by regulations of the Board and to maintain the operation of the proposed school for 1 year;\n(d) Proof that the proposed school will commence operation with an enrollment of a number of students acceptable to the Board;\n(e) The applicable fee for a license;\n(f) A copy of the contract for the enrollment of a student in a program at the school of cosmetology; and\n(g) The name and address of the person designated to accept service of process.\n2. Upon receipt by the Board of the application, the Board shall, before issuing a license, determine whether the proposed school:\n(a) Is suitably located.\n(b) Contains adequate floor space and adequate equipment.\n(c) Has a contract for the enrollment of a student in a program at the school of cosmetology that is approved by the Board.\n(d) Admits as regular students only persons who have received a certificate of graduation from high school, or the recognized equivalent of such a certificate, or who are beyond the age of compulsory school enrollment and attendance.\n(e) Meets all requirements established by regulations of the Board.\n3. The fee for issuance of a license for a school of cosmetology is:\n(a) For 2 years, not less than $500 and not more than $800.\n(b) For 4 years, not less than $1,000 and not more than $1,600.\n4. If the proposed school meets all requirements established by this chapter and the regulations adopted pursuant thereto, the Board shall issue a license to the proposed school. The license must contain:\n(a) The name of the proposed school;\n(b) A statement that the proposed school is authorized to operate educational programs beyond secondary education; and\n(c) Such other information as the Board considers necessary.\n5. If the ownership of the school changes or the school moves to a new location, the school may not be operated until a new license is issued by the Board.\n6. The Board shall, by regulation, prescribe:\n(a) The minimum enrollment of students required by paragraph (d) of subsection 1; and\n(b) The amount of floor space required by paragraph (b) of subsection 2.\n7.
