Any renewable energy system:\n(a) Placed into operation before July 1, 1997, if a provider of electric service used electricity generated or acquired from the renewable energy system to satisfy its portfolio standard before July 1, 2009;\n(b) Placed into operation before July 1, 1997, that uses waterpower from a plant, facility, equipment or system to generate electricity, if the waterpower is acquired by the provider of electric service from another party pursuant to a contract for a term of not less than 10 years and the provider of electric service began acquiring the waterpower from the plant, facility, equipment or system before April 22, 2019; or\n(c) Placed into operation on or after July 1, 1997.\n2.
