If and only to the extent the\nimposition of a fee is required by federal law and regulation to insure\ncontinued full federal financial participation in the state's plan for\nservices under applicable federal law and regulations, the department\nshall, by regulation, require a local social services district to impose\na fee for any service made available by that district to an individual\nwho is not a recipient of public assistance and care.
