Code § 20-934","heading":"§ 20-934 Civil action for pattern or practice of violations.","body":"a. \n\t\t\t\t\t\t\t\t\t\t\t\tCause of action.\n\n1. Where reasonable cause exists to believe that a hiring party is engaged in a pattern or practice of violations of this chapter, the corporation counsel may commence a civil action on behalf of the city in a court of competent jurisdiction.\n\n2. An action pursuant to paragraph 1 of this subdivision shall be commenced by filing a complaint setting forth facts relating to such pattern or practice and requesting relief, which may include injunctive relief, civil penalties and any other appropriate relief.\n\n3. Nothing in this section prohibits:\n\n(a) A person alleging a violation of this chapter from filing a civil action pursuant to section 20-933 based on the same facts as a civil action commenced by the corporation counsel pursuant to this section.\n\n(b) The commissioner from sending a notice of complaint pursuant to section 20-931, unless otherwise barred from doing so.\n\nb. \n\t\t\t\t\t\t\t\t\t\t\t\tCivil penalty. In any civil action commenced pursuant to subdivision a of this section, the trier of fact may impose a civil penalty of not more than $25,000 for a finding that a hiring party has engaged in a pattern or practice of violations of this chapter. Any civil penalty so recovered shall be paid into the general fund of the city.\n\n(L.L. 2016/140, 11/16/2016, eff. 5/15/2017; Am.
