Code § BC 3317","heading":"Section BC 3317: Material Hoists and Bucket Hoists","body":"3317.1 Scope.\n\nMaterial hoists and bucket hoists shall meet and be used in accordance with the requirements of this section, Section 3316, and rules promulgated by the commissioner.\n\nException: Equipment that is exempted from the requirements of Section 3316.1.\n\n3317.2 Permit.\n\nMaterial hoists and bucket hoists shall require a permit in accordance with Section 3316.4.\n\n3317.3 Design and inspection.\n\nMaterial hoists, bucket hoists and their components shall be designed and inspected in accordance with rules promulgated by the commissioner.\n\n3317.4 Construction.\n\nMaterial hoists, bucket hoists and their components shall be constructed in compliance with the manufacturing specifications, the requirements of this code, and rules promulgated by the commissioner. If there is a discrepancy, the stricter requirement shall be met.\n\nUpon completion of the installation of the hoisting equipment and/or its runback structure, an inspection report verifying that the hoist has been installed in accordance with the design drawings, construction documents and specifications shall be prepared by the designer, installer or an approved inspection agency designated by both the designer and installer.\n\n3317.5 Operation.\n\nNotwithstanding any other provision of law, material hoists with a manufacturer's capacity over one ton shall be operated only by persons holding a Class A or Class B Hoisting Machine Operators License except during installation, jumping, dismantling or alteration operations.\n\n3317.6 Making safety devices inoperative.\n\nNo person shall at any time make any required safety device or electrical protective device inoperative except when necessary during tests, inspections, and maintenance.\n\nImmediately upon completion of the tests, inspections, and maintenance, such devices shall be restored to their normal operating condition in conformance with the applicable requirements of this section.","path":["New York City Administrative Code","Title 28","Chapter 7: New York City Building Code"],"source_url":"https://files.amlegal.com/pdffiles/NewYorkCity/Admin/XML.zip","current_through":"Local Law 2026/135 (enacted August 31, 2026)","vintage":"","retrieved_at":"2026-09-06T02:48:57Z","sha256":"5f7362d77ee29a733058cc1d7e22447e742a9f25e0cb0b2cde0b1b96046220b6","source_id":"us-nyc","stale":false,"prev":"us-nyc/n.y.c.-admin.-code-bc-3316","next":"us-nyc/n.y.c.-admin.-code-bc-3318"},"notice":"GroundRules: Original legal text.
