Code § BC 3318","heading":"Section BC 3318: Personnel Hoists","body":"3318.1 Scope.\n\nPersonnel hoists shall meet and be used in accordance with the requirements of this section, Section 3316, and rules promulgated by the commissioner.\n\nException: Equipment that is exempted from the requirements of Section 3316.1.\n\n3318.2 Permit.\n\nPersonnel hoists shall require a permit in accordance with Section 3316.4.\n\n3318.3 Design and inspection.\n\nPersonnel hoists and their components shall be designed and inspected in accordance with rules promulgated by the commissioner.\n\n3318.4 Construction.\n\nPersonnel hoists and their components shall be constructed in compliance with the manufacturer's specifications, this code, and rules promulgated by the commissioner. If there is a discrepancy, the stricter requirement shall be met.\n\nUpon completion of the installation of the hoisting equipment and/or its runback structure, an inspection report verifying that the hoist has been installed in accordance with the design drawings, construction documents and specifications shall be prepared by the designer, installer or third party designated by both the designer and installer and acceptable to the commissioner.\n\n3318.5 Operation.\n\nPersonnel hoists and their components shall be operated in accordance with this code and rules promulgated by the commissioner.\n\nWhen the hoist is equipped with manual controls, the hoist shall be operated by a qualified operator. Only the operator authorized by the equipment user shall operate the hoist.\n\n3318.6 Making safety devices inoperative.\n\nNo person shall at any time make any required safety device or electrical protective device inoperative except when necessary during tests, inspections and maintenance.\n\nImmediately upon completion of the tests, inspections and maintenance, such devices shall be restored to their normal operating condition in conformance with the applicable requirements of this section.","path":["New York City Administrative Code","Title 28","Chapter 7: New York City Building Code"],"source_url":"https://files.amlegal.com/pdffiles/NewYorkCity/Admin/XML.zip","current_through":"Local Law 2026/135 (enacted August 31, 2026)","vintage":"","retrieved_at":"2026-09-06T02:48:57Z","sha256":"f1779b66d93f5325c02a1874283cfb26b35153335cefa24beaa074feaae70faf","source_id":"us-nyc","stale":false,"prev":"us-nyc/n.y.c.-admin.-code-bc-3317","next":"us-nyc/n.y.c.-admin.-code-bc-3319"},"notice":"GroundRules: Original legal text.
