Code § FC 305","heading":"Section FC 305: Ignition Sources","body":"305.1 Clearance from ignition sources.\n\nClearance between ignition sources, such as luminaires, heaters and open-flame devices, and combustible materials shall be maintained in an approved manner.\n\n305.2 Hot ashes and spontaneous ignition sources.\n\nHot ashes, cinders, smoldering coals or greasy or oily materials subject to spontaneous ignition shall not be deposited in a combustible container, or within 10 feet (3048 mm) of other combustible material, including combustible walls and partitions and combustible waste, or within 2 feet (610 mm) of openings to buildings or structures.\n\nException: The minimum required separation distance to other combustible materials shall be 2 feet (610 mm) where the material is deposited in a covered, noncombustible container placed on a noncombustible floor, ground surface or stand.\n\n305.3 Open-flame warning devices.\n\nIt shall be unlawful to use an open-flame device on roadways as a warning signal or for any other purposes.\n\nException: The use of fusees at the scene of an emergency or as required by standard railroad operating procedures.\n\n305.4 Deliberate or negligent burning.\n\nIt shall be unlawful to deliberately or through negligence set fire to or cause the burning of combustible material or combustible waste in such a manner as to endanger the safety of persons or property.","path":["New York City Administrative Code","Title 29","Chapter 2: New York City Fire Code"],"source_url":"https://files.amlegal.com/pdffiles/NewYorkCity/Admin/XML.zip","current_through":"Local Law 2026/135 (enacted August 31, 2026)","vintage":"","retrieved_at":"2026-09-06T02:48:57Z","sha256":"0ea0748c93ab58e29e40a30172b919a97d6b75397ec6da178bdc437382fce053","source_id":"us-nyc","stale":false,"prev":"us-nyc/n.y.c.-admin.-code-fc-304","next":"us-nyc/n.y.c.-admin.-code-fc-306"},"notice":"GroundRules: Original legal text.
