Code § FC 3603","heading":"Section FC 3603: General Precautions","body":"3603.1 Fire safety precautions.\n\nMarinas shall comply with the fire safety precautions set forth in NFPA 303 and this section.\n\n3603.2 Combustible waste.\n\nMarinas shall be kept free of accumulations of combustible waste in accordance with FC 304. Rubbish and other combustible waste shall not be allowed to accumulate beneath marina structures, piers or wharves.\n\n3603.3 Sources of ignition.\n\nOpen flames and open-flame devices shall not be used within 3 feet (914 mm) of combustible material. Open flames, open-flame devices and other sources of ignition shall not be stored or used in the areas in which smoking is prohibited pursuant to FC 3603.3.1. Portable electric lights approved for use in a hazardous location shall be used where flammable vapors may be present, and shall be equipped with safety devices designed to prevent physical damage to the bulbs.\n\n3603.3.1 Smoking.\n\nIt shall be unlawful to smoke in the following areas of a marina, and any other areas as the commissioner may prescribe by rule:\n\n1. Where fuels are stored or dispensed.\n\n2. Where flammable or combustible liquids are stored, handled or used.\n\n3. Battery storage and battery charging areas.\n\n4. Covered or enclosed boat storage areas.\n\n3603.4 Lumber and other combustible material storage.\n\nLumber and other combustible materials shall be stored in accordance with FC Chapter 28, at a location separate from the area in which marine vessel construction or repair, marine vessel or watercraft fueling, or other work involving the handling or use of flammable or combustible liquids or open flames is conducted.","path":["New York City Administrative Code","Title 29","Chapter 2: New York City Fire Code"],"source_url":"https://files.amlegal.com/pdffiles/NewYorkCity/Admin/XML.zip","current_through":"Local Law 2026/135 (enacted August 31, 2026)","vintage":"","retrieved_at":"2026-09-06T02:48:57Z","sha256":"b7ce6105d44b9b763bfe078165e9f49577a80e767fc85a724a2d02c7022d3227","source_id":"us-nyc","stale":true,"prev":"us-nyc/n.y.c.-admin.-code-fc-3602","next":"us-nyc/n.y.c.-admin.-code-fc-3604"},"notice":"GroundRules: Original legal text.
