Code § 1107.03","heading":"Evaluating adequacy of bank's capital.","body":"No state bank shall operate without adequate capital as determined by the superintendent of financial institutions. In evaluating the adequacy of a state bank's capital, the superintendent may consider any of the following:\n(A) The nature and volume of the bank's business;\n(B) The amount, nature, quality, and liquidity of the bank's assets;\n(C) The amount and nature of the bank's liabilities, including those that are not presently due or are contingent;\n(D) The amount and nature of the bank's fixed costs;\n(E) The history of and prospects for the bank to earn and retain income;\n(F) The quality of the bank's operations, including risk management;\n(G) The quality of the bank's management;\n(H) The nature and quality of the bank's ownership;\n(I) Any other factor the superintendent finds to be relevant under the circumstances.","path":["Title 11 Banks-Savings and Loan Associations","Chapter 1107 State Banks - Capital And Securities"],"source_url":"https://codes.ohio.gov/ohio-revised-code/section-1107.03","current_through":"2018-01-01 (House Bill 49 - 132nd General Assembly)","vintage":"","retrieved_at":"2026-09-14T19:24:28Z","sha256":"8027c799b76a98d85d708f050ea03a9711024bc038c828dfbf5690360aa9456a","source_id":"us-oh","stale":false,"prev":"us-oh/ohio-rev.-code-1105.11","next":"us-oh/ohio-rev.-code-1107.05"},"notice":"GroundRules: Original legal text.
