Code § 1302.09","heading":"Offer and acceptance in formation of contract - UCC 2-206.","body":"(A) Unless otherwise unambiguously indicated by the language or circumstances:\n(1) an offer to make a contract shall be construed as inviting acceptance in any manner and by any medium reasonable in the circumstances;\n(2) an order or other offer to buy goods for prompt or current shipment shall be construed as inviting acceptance either by a prompt promise to ship or by the prompt or current shipment of conforming or non-conforming goods, but such a shipment of non-conforming goods does not constitute an acceptance if the seller seasonably notifies the buyer that the shipment is offered only as an accommodation to the buyer.\n(B) Where the beginning of a requested performance is a reasonable mode of acceptance an offeror who is not notified of acceptance within a reasonable time may treat the offer as having lapsed before acceptance.","path":["Title 13 Commercial Transactions","Chapter 1302 Sales"],"source_url":"https://codes.ohio.gov/ohio-revised-code/section-1302.09","current_through":"1962-07-01 (Senate Bill 5 - 104th General Assembly)","vintage":"","retrieved_at":"2026-09-14T19:24:29Z","sha256":"4aa1a0cf387a3c95c34f573d19b304a09f6445e916f9337d472a98e216abe735","source_id":"us-oh","stale":false,"prev":"us-oh/ohio-rev.-code-1302.08","next":"us-oh/ohio-rev.-code-1302.10"},"notice":"GroundRules: Original legal text.
