Code § 1302.35","heading":"Delivery ex-ship - UCC 2-322.","body":"(A) Unless otherwise agreed a term for delivery of goods \"ex-ship\" (which means from the carrying vessel) or in equivalent language is not restricted to a particular ship and requires delivery from a ship which has reached a place at the named port of destination where goods of the kind are usually discharged.\n(B) Under such a term unless otherwise agreed:\n(1) the seller must discharge all liens arising out of the carriage and furnish the buyer with a direction which puts the carrier under a duty to deliver the goods; and\n(2) the risk of loss does not pass to the buyer until the goods leave the ship's tackle or are otherwise properly unloaded.","path":["Title 13 Commercial Transactions","Chapter 1302 Sales"],"source_url":"https://codes.ohio.gov/ohio-revised-code/section-1302.35","current_through":"1962-07-01 (Senate Bill 5 - 104th General Assembly)","vintage":"","retrieved_at":"2026-09-14T19:24:29Z","sha256":"a0c5e2b24f37699553530f5910798804bb2117add7a1cae6ef9349101d9a6f4c","source_id":"us-oh","stale":false,"prev":"us-oh/ohio-rev.-code-1302.34","next":"us-oh/ohio-rev.-code-1302.36"},"notice":"GroundRules: Original legal text.
