Code § 1308.04","heading":"Evidentiary rules concerning certificate securities - UCC 8-114.","body":"The following rules apply in an action on a certificated security against the issuer:\n(A) Unless specifically denied in the pleadings, each signature on a security certificate or in a necessary indorsement is admitted;\n(B) If the effectiveness of a signature is put in issue, the burden of establishing effectiveness is on the party claiming under the signature, but the signature is presumed to be genuine or authorized;\n(C) If signatures on a security certificate are admitted or established, production of the certificate entitles a holder to recover on it unless the defendant establishes a defense or a defect going to the validity of the security;\n(D) If it is shown that a defense or defect exists, the plaintiff has the burden of establishing that the plaintiff or some person under whom the plaintiff claims is a person against whom the defense or defect cannot be asserted.","path":["Title 13 Commercial Transactions","Chapter 1308 Investment Securities"],"source_url":"https://codes.ohio.gov/ohio-revised-code/section-1308.04","current_through":"1998-01-01 (House Bill 170 - 122nd General Assembly)","vintage":"","retrieved_at":"2026-09-14T19:24:29Z","sha256":"42d2320b7080829c36c7dfa5d4fbb3034773ea694a59224d94554c9a1d9fb927","source_id":"us-oh","stale":false,"prev":"us-oh/ohio-rev.-code-1308.03","next":"us-oh/ohio-rev.-code-1308.05"},"notice":"GroundRules: Original legal text.
