Code § 1337.36","heading":"Judicial relief.","body":"(A) Any of the following persons may petition a court to construe a power of attorney or review the agent's conduct and grant appropriate relief:\n(1) The principal or the agent;\n(2) A guardian, conservator, or other fiduciary acting for the principal, including an executor or administrator of the estate of a deceased principal;\n(3) A person authorized to make health-care decisions for the principal;\n(4) The principal's spouse, parent, or descendant;\n(5) An individual who would qualify as a presumptive heir of the principal;\n(6) A person named as a beneficiary to receive any property, benefit, or contractual right on the principal's death or as a beneficiary of a trust created by or for the principal that has a financial interest in the principal's estate;\n(7) A governmental agency having regulatory authority to protect the welfare of the principal;\n(8) The principal's caregiver or another person that demonstrates sufficient interest in the principal's welfare;\n(9) A person asked to accept the power of attorney.\n(B) Upon motion by the principal, the court shall dismiss a petition filed under this section, unless the court finds that the principal lacks capacity to revoke the agent's authority or the power of attorney.","path":["Title 13 Commercial Transactions","Chapter 1337 Power Of Attorney"],"source_url":"https://codes.ohio.gov/ohio-revised-code/section-1337.36","current_through":"2012-03-22 (Senate Bill 117 - 129th General Assembly)","vintage":"","retrieved_at":"2026-09-14T19:24:29Z","sha256":"2ec2ee3db871d8131c7873043d0ce644f2b0d8974d6f75af4f483562d3984c91","source_id":"us-oh","stale":false,"prev":"us-oh/ohio-rev.-code-1337.35","next":"us-oh/ohio-rev.-code-1337.37"},"notice":"GroundRules: Original legal text.
