Code § 145.382","heading":"Employment of certain retirants notwithstanding restrictions.","body":"(A) A former member receiving an age and service retirement allowance from the public employees retirement system, and hereafter referred to as a retirant, may be employed, notwithstanding sections 145.38 and 145.46 of the Revised Code, if his later employment has been in a position described in any of the following categories:\n(1) A position authorized by section 101.31, 121.03, or 121.04 of the Revised Code;\n(2) A position to which appointment is made by the governor with the advice and consent of the senate;\n(3) The head of a division of a state department.\nA retirant employed in such a category is entitled to a retirement allowance based on his total contributions and service credit accrued during all service as a public employee.\n(B) Upon his later retirement, the retirant may elect to receive retirement benefits based upon his original service and his service after re-entering public service by selecting any of the optional benefit plans specified in section 145.46 of the Revised Code.","path":["Title 1 State Government","Chapter 145 Public Employees Retirement System"],"source_url":"https://codes.ohio.gov/ohio-revised-code/section-145.382","current_through":"1992-07-29 (Senate Bill 346 - 119th General Assembly)","vintage":"","retrieved_at":"2026-09-14T19:24:25Z","sha256":"208777137d71b5d902a57ebc43e9f458de697bf576e57868a54e68fb848aa0a8","source_id":"us-oh","stale":false,"prev":"us-oh/ohio-rev.-code-145.381","next":"us-oh/ohio-rev.-code-145.383"},"notice":"GroundRules: Original legal text.
