Code § 2105.34","heading":"Co-owners with right of survivorship.","body":"Except as provided in section 2105.36 of the Revised Code, the following shall apply:\n(A) If it is not established by clear and convincing evidence that one of two co-owners with right of survivorship survived the other co-owner by one hundred twenty hours, one-half of the property or account passes as if one co-owner had survived the other co-owner by one hundred twenty hours, and one-half of the property or account passes as if the other co-owner had survived the one co-owner by one hundred twenty hours.\n(B) If there are more than two co-owners with right of survivorship and it is not established by clear and convincing evidence that at least one of the co-owners survived the others by one hundred twenty hours, the property or account passes in the proportion that one co-owner's ownership bears to the ownership of the whole number of co-owners.","path":["Title 21 Courts-Probate-Juvenile","Chapter 2105 Descent And Distribution"],"source_url":"https://codes.ohio.gov/ohio-revised-code/section-2105.34","current_through":"2017-04-06 (House Bill 432 - 131st General Assembly)","vintage":"","retrieved_at":"2026-09-14T19:24:30Z","sha256":"a38511d2cc4f3bc729fb6e43de8d409cccf13ee12739dd2a362c1f6561ac705c","source_id":"us-oh","stale":false,"prev":"us-oh/ohio-rev.-code-2105.33","next":"us-oh/ohio-rev.-code-2105.35"},"notice":"GroundRules: Original legal text.
