Code § 2901.09","heading":"No duty to retreat in residence or vehicle.","body":"(A) As used in this section, \"residence\" has the same meaning as in section 2901.05 of the Revised Code.\n(B) For purposes of any section of the Revised Code that sets forth a criminal offense, a person has no duty to retreat before using force in self-defense, defense of another, or defense of that person's residence if that person is in a place in which the person lawfully has a right to be.\n(C) A trier of fact shall not consider the possibility of retreat as a factor in determining whether or not a person who used force in self-defense, defense of another, or defense of that person's residence reasonably believed that the force was necessary to prevent injury, loss, or risk to life or safety.","path":["Title 29 Crimes-Procedure","Chapter 2901 General Provisions"],"source_url":"https://codes.ohio.gov/ohio-revised-code/section-2901.09","current_through":"2021-04-06 (Senate Bill 175 - 133rd General Assembly)","vintage":"","retrieved_at":"2026-09-14T19:24:31Z","sha256":"b751d22d93650042e3f89f5734dcb30832e72c553e39038db0e9cf07daa3909f","source_id":"us-oh","stale":false,"prev":"us-oh/ohio-rev.-code-2901.08","next":"us-oh/ohio-rev.-code-2901.10"},"notice":"GroundRules: Original legal text.
