Code § 3105.01","heading":"Divorce causes.","body":"The court of common pleas may grant divorces for the following causes:\n(A) Either party had a husband or wife living at the time of the marriage from which the divorce is sought;\n(B) Willful absence of the adverse party for one year;\n(C) Adultery;\n(D) Extreme cruelty;\n(E) Fraudulent contract;\n(F) Any gross neglect of duty;\n(G) Habitual drunkenness;\n(H) Imprisonment of the adverse party in a state or federal correctional institution at the time of filing the complaint;\n(I) Procurement of a divorce outside this state, by a husband or wife, by virtue of which the party who procured it is released from the obligations of the marriage, while those obligations remain binding upon the other party;\n(J) On the application of either party, when husband and wife have, without interruption for one year, lived separate and apart without cohabitation;\n(K) Incompatibility, unless denied by either party.\nA plea of res judicata or of recrimination with respect to any provision of this section does not bar either party from obtaining a divorce on this ground.","path":["Title 31 Domestic Relations-Children","Chapter 3105 Divorce, Alimony, Annulment, Dissolution Of Marriage"],"source_url":"https://codes.ohio.gov/ohio-revised-code/section-3105.01","current_through":"1994-10-06 (House Bill 571 - 120th General Assembly)","vintage":"","retrieved_at":"2026-09-14T19:24:32Z","sha256":"7c27104c6f4a659918a207dcad363884af17b788c205db5cb65cb05deaa36136","source_id":"us-oh","stale":false,"prev":"us-oh/ohio-rev.-code-3103.08","next":"us-oh/ohio-rev.-code-3105.011"},"notice":"GroundRules: Original legal text.
