Code § 3105.821","heading":"Monthly benefit.","body":"The monthly benefit used under division (D)(2) of section 3105.82 of the Revised Code to determine the amount to be paid an alternate payee from a monthly benefit shall be whichever of the following applies:\n(A) If the participant is receiving a monthly benefit, the monthly benefit shall be the benefit the participant is receiving at the time the decree of divorce or dissolution becomes final;\n(B) If the participant has applied for but is not yet receiving a monthly benefit, the monthly benefit shall be the benefit for which the participant is eligible;\n(C) If the participant has not applied for a benefit, the monthly benefit shall be the benefit calculated at the time the participant elects to take it.","path":["Title 31 Domestic Relations-Children","Chapter 3105 Divorce, Alimony, Annulment, Dissolution Of Marriage"],"source_url":"https://codes.ohio.gov/ohio-revised-code/section-3105.821","current_through":"2002-01-01 (House Bill 535 - 123rd General Assembly)","vintage":"","retrieved_at":"2026-09-14T19:24:32Z","sha256":"f297bd34873fa33969db764183ecb05ffff7e1d491de29e783a401c890de9b42","source_id":"us-oh","stale":false,"prev":"us-oh/ohio-rev.-code-3105.82","next":"us-oh/ohio-rev.-code-3105.83"},"notice":"GroundRules: Original legal text.
