Code § 3796.29","heading":"Limitations on number of cultivators, processors, or retail dispensaries by localities.","body":"(A) Except as otherwise provided in division (B) of this section, the legislative authority of a municipal corporation or a board of township trustees may adopt an ordinance or a resolution, to prohibit, or limit the number of, licensed cultivators, licensed processors, or licensed dispensaries within the municipal corporation or within the unincorporated territory of the township, respectively.\n(B) The legislative authority of a municipal corporation or a board of township trustees shall not adopt or enforce an ordinance or a resolution that does any of the following:\n(1) Prohibits or limits the operations of a license holder that received a provisional license or certificate of operation before the effective date of this amendment, except that a municipal corporation or township may enforce such an ordinance or such a resolution if it was adopted before the effective date of this amendment ;\n(2) Prohibits or limits any activity authorized under this chapter, except as expressly permitted under division (A) of this section;\n(3) Prohibits or limits research related to marijuana conducted at a state university, academic medical center, or private research and development organization as part of a research protocol approved by an institutional review board or equivalent entity.","path":["Title 37 Health-Safety-Morals","Chapter 3796 Marijuana Control Program"],"source_url":"https://codes.ohio.gov/ohio-revised-code/section-3796.29","current_through":"2026-03-20 (Senate Bill 56 - 136th General Assembly)","vintage":"","retrieved_at":"2026-09-14T19:24:35Z","sha256":"7cb6bd64b0c1b6fcc6667a0cfdb01773b92a77c89bda2d1e84ad58ec620bf9ac","source_id":"us-oh","stale":false,"prev":"us-oh/ohio-rev.-code-3796.28","next":"us-oh/ohio-rev.-code-3796.30"},"notice":"GroundRules: Original legal text.
