{"data":{"id":"us-oh/ohio-rev.-code-3797.12","jurisdiction":"us-oh","citation":"Ohio Rev. Code § 3797.12","heading":"Persons immune from civil liability for acts or omissions.","body":"(A) Except as provided in division (B) of this section, any of the following persons shall be immune from liability in a civil action to recover damages for injury, death, or loss to person or property allegedly caused by an act or omission in connection with a power, duty, responsibility, or authorization under sections 3797.01 to 3797.10 of the Revised Code or under rules adopted under authority of those sections:\n(1) The attorney general, a deputy, officer, or employee of the office of the attorney general, a sheriff, or a deputy, officer, or employee of the office of the sheriff;\n(2) A prosecutor and an officer or employee of the office of a prosecutor;\n(3) A person identified in division (A)(2), (3), (4), (5), (6), or (7) of section 3797.06 of the Revised Code or the agent of that person;\n(4) A person identified in division (A)(2) of section 3797.05 of the Revised Code, regarding the person's provision of information pursuant to that division to a sheriff.\n(B) The immunity described in division (A) of this section does not apply to a person described in divisions (A)(1) to (4) of this section if, in relation to the act or omission in question, any of the following applies:\n(1) The act or omission was manifestly outside the scope of the person's employment or official responsibilities.\n(2) The act or omission was with malicious purpose, in bad faith, or in a wanton or reckless manner.\n(3) Liability for the act or omission is expressly imposed by a section of the Revised Code.","path":["Title 37 Health-Safety-Morals","Chapter 3797 Childhood Sexual Abuse Registration and Community Notification"],"source_url":"https://codes.ohio.gov/ohio-revised-code/section-3797.12","current_through":"2025-04-09 (House Bill 322 - 135th General Assembly)","vintage":"","retrieved_at":"2026-09-14T19:24:35Z","sha256":"0e35ca6290fa3ca825947af239a968080d44a62eac98e4a8de0ad07d79d973df","source_id":"us-oh","stale":false,"prev":"us-oh/ohio-rev.-code-3797.10","next":"us-oh/ohio-rev.-code-3798.01"},"notice":"GroundRules: Original legal text.
