Code § 3961.03","heading":"Written agreement with marketer required.","body":"(A) Prior to a discount medical plan organization allowing a marketer to market, promote, sell, or distribute a discount medical plan, the organization shall enter into a written agreement with the marketer. This agreement shall prohibit the marketer from using or issuing any advertising, marketing materials, brochures, or discount medical cards without the organization's written approval.\n(B) A discount medical plan organization is bound by and responsible for a marketer's activities that are within the scope of the marketer's agency relationship with the organization.\n(C) A discount medical plan organization shall approve in writing all advertisements, marketing materials, brochures, and discount cards prior to a marketer using these materials to market, promote, sell, or distribute the discount medical plan.","path":["Title 39 Insurance","Chapter 3961 Discount Medical Plans"],"source_url":"https://codes.ohio.gov/ohio-revised-code/section-3961.03","current_through":"2007-03-23 (Senate Bill 5 - 126th General Assembly)","vintage":"","retrieved_at":"2026-09-14T19:24:36Z","sha256":"bedf87f4f80817a3d90c0023a4ad85afed784ae60775a052eb2ad4260bd251d8","source_id":"us-oh","stale":false,"prev":"us-oh/ohio-rev.-code-3961.02","next":"us-oh/ohio-rev.-code-3961.04"},"notice":"GroundRules: Original legal text.
