{"data":{"id":"us-oh/ohio-rev.-code-4713.14","jurisdiction":"us-oh","citation":"Ohio Rev. Code § 4713.14","heading":"Prohibited acts.","body":"No individual shall do any of the following:\n(A) Use fraud or deceit in obtaining or making application for a license, permit, or registration;\n(B) Aid or abet any individual or entity in any of the following:\n(1) Violating this chapter or a rule adopted under it;\n(2) Obtaining a license, permit, or registration fraudulently;\n(3) Falsely pretending to hold a current, valid license or permit.\n(C) Practice a branch of cosmetology, for pay, free, or otherwise, without one of the following authorizing the practice of that branch of cosmetology:\n(1) A current, valid license under section 4713.28, 4713.30, or 4713.34 of the Revised Code;\n(2) A current, valid temporary pre-examination work permit issued under section 4713.22 of the Revised Code;\n(3) A current, valid temporary special occasion work permit issued under section 4713.37 of the Revised Code;\n(4) A current, valid registration under section 4713.69 of the Revised Code.\n(D) Employ an individual to practice a branch of cosmetology if the individual does not hold one of the following authorizing the practice of that branch of cosmetology:\n(1) A current, valid license under section 4713.28, 4713.30, or 4713.34 of the Revised Code;\n(2) A current, valid temporary pre-examination work permit issued under section 4713.22 of the Revised Code;\n(3) A current, valid temporary special occasion work permit issued under section 4713.37 of the Revised Code;\n(4) A current, valid registration under section 4713.69 of the Revised Code.\n(E) Except for apprentice instructors and as provided in section 4713.45 of the Revised Code, teach the theory or practice of a branch of cosmetology at a school without either of the following authorizing the teaching of that branch of cosmetology:\n(1) A current, valid license under section 4713.31 or 4713.34 of the Revised Code;\n(2) A current, valid temporary special occasion work permit issued under section 4713.37 of the Revised Code.\n(F) Advertise or operate a glamour photography service in which a branch of cosmetology is practiced unless the individual practicing the branch of cosmetology holds either of the following authorizing the practice of that branch of cosmetology:\n(1) A current, valid license under section 4713.28, 4713.30, or 4713.34 of the Revised Code;\n(2) A current, valid temporary special occasion work permit issued under section 4713.37 of the Revised Code.\n(G) Advertise or operate a glamour photography service in which a branch of cosmetology is practiced at a location not specified by rules adopted under section 4713.08 of the Revised Code;\n(H) Practice a branch of cosmetology at a salon as an independent contractor without a current, valid independent contractor license issued under section 4713.39 of the Revised Code;\n(I) Operate a salon without a current, valid license under section 4713.41 of the Revised Code;\n(J) Provide any of the following at a salon for pay, free, or otherwise:\n(1) Massage therapy, unless the individual has a current, valid license issued by the state medical board under section 4731.15 of the Revised Code;\n(2) Any other professional service, unless the individual has a current, valid license or certificate issued by the professional regulatory board of this state that regulates the profession;\n(3) Cosmetic therapy, unless the individual is authorized by rules adopted under section 4713.08 of the Revised Code.\n(K) Teach a branch of cosmetology at a salon, unless the individual receiving the instruction holds either of the following authorizing the practice of that branch of cosmetology:\n(1) A current, valid license under section 4713.28, 4713.30, or 4713.34 of the Revised Code;\n(2) A current, valid temporary pre-examination work permit issued under section 4713.22 of the Revised Code.\n(L) Operate a school without a current, valid license under section 4713.44 of the Revised Code;\n(M) At a salon or school, do any of the following:\n(1) Use or possess a cosmetic product containing an ingredient that the United States food and drug administration has prohibited by regulation;\n(2) Use a cosmetic product in a manner inconsistent with a restriction established by the United States food and drug administration by regulation;\n(3) Use or possess a liquid nail monomer containing any trace of methyl methacrylate (MMA).\n(N) While in charge of a salon or school, permit any individual to sleep in, or use for residential purposes, any room used wholly or in part as the salon or school;\n(O) Maintain, as an established place of business for the practice of one or more of the branches of cosmetology, a room used wholly or in part for sleeping or residential purposes;\n(P) Operate a tanning facility that is offered to the public for a fee or other compensation without a current, valid permit under section 4713.48 of the Revised Code;\n(Q) Practice a branch of cosmetology in a location other than a licensed facility unless otherwise exempted under section 4713.16, 4713.17, or 4713.351 of the Revised Code;\n(R) Use any of the services or arts that are part of the practice of a branch of cosmetology to treat or attempt to cure a physical or mental disease or ailment.","path":["Title 47 Occupations-Professions","Chapter 4713
