Code § 4905.23","heading":"Electric generating plant closure prohibited.","body":"(A) As used in this section, \"base load electric generating facility\" means an electric generating plant and associated facilities located in this state that primarily uses a nonrenewable fuel source to generate electricity, including natural gas and nuclear reaction, and that is not owned or operated by a public utility, municipal corporation, or electric cooperative.\n(B) No person shall enter into a settlement to abandon, close, or shut down either of the following:\n(1) A base load electric generating facility;\n(2) A generating plant owned or operated by a public utility.","path":["Title 49 Public Utilities","Chapter 4905 Public Utilities Commission - General Powers"],"source_url":"https://codes.ohio.gov/ohio-revised-code/section-4905.23","current_through":"2025-08-14 (House Bill 15 - 136th General Assembly)","vintage":"","retrieved_at":"2026-09-14T19:24:38Z","sha256":"ddf835cb8c7ad54406782783baf05fd0d27d9c90b9c08f4bc4cce78b074f61f4","source_id":"us-oh","stale":false,"prev":"us-oh/ohio-rev.-code-4905.22","next":"us-oh/ohio-rev.-code-4905.26"},"notice":"GroundRules: Original legal text.
