Code § 5126.22","heading":"Classification of employees.","body":"(A) Employees who hold the following positions in a county board of developmental disabilities are management employees:\nassistant superintendent\ndirector of business\ndirector of personnel\nadult services director\nworkshop director\nhabilitation manager\ndirector of residential services\nprincipal (director of children services)\nprogram or service supervisor\nplant manager\nproduction manager\nservice and support administration supervisor\ninvestigative agent\nconfidential employees as defined in section 4117.01 of the Revised Code\npositions designated by the director of developmental disabilities as having managerial or supervisory responsibilities and duties\npositions designated by the county board in accordance with division (D) of this section.\n(B) Employees who hold the following positions in a board are professional employees:\npersonnel licensed or certified pursuant to Chapter 3319. of the Revised Code\nearly intervention specialist\nphysical development specialist\nhabilitation specialist\nwork adjustment specialist\nplacement specialist\nvocational evaluator\npsychologist\noccupational therapist\nspeech and language pathologist\nrecreation specialist\nbehavior management specialist\nphysical therapist\nsupportive home services specialist\nlicensed practical nurse or registered nurse\nrehabilitation counselor\ndoctor of medicine and surgery or of osteopathic medicine and surgery\ndentist\nservice and support administrator\nconditional status service and support administrator\nsocial worker\nany position that is not a management position and for which the standards for certification established by the director of developmental disabilities under section 5126.25 of the Revised Code require a bachelor's or higher degree\nprofessional positions designated by the director\nprofessional positions designated by the county board in accordance with division (D) of this section.\n(C) Employees who hold positions in a board that are neither management positions nor professional positions are service employees. Service employee positions include:\nworkshop specialist\nworkshop specialist assistant\ncontract procurement specialist\ncommunity employment specialist\nany assistant to a professional employee certified to provide, or supervise the provision of, service and support administration\nany assistant to a professional employee providing or supervising the provision of adult services\nservice positions designated by the director\nservice positions designated by a county board in accordance with division (D) of this section.\n(D) A county board may designate a position only if the position does not include directly providing, or supervising employees who directly provide, service or instruction to individuals with developmental disabilities.\n(E) If a county board desires to have a position established that is not specifically listed in this section that includes directly providing, or supervising employees who directly provide, services or instruction to individuals with developmental disabilities, the board shall submit to the director a written description of the position and request that the director designate the position as a management, professional, or service position under this section. The director shall consider each request submitted under this division and respond within thirty days. If the director approves the request, the director shall designate the position as a management, professional, or service position.\n(F) A county board shall not terminate its employment of any management, professional, or service employee solely because a position is added to or eliminated from those positions listed in this section or because a position is designated or no longer designated by the director or a county board.","path":["Title 51 Public Welfare","Chapter 5126 County Boards of Developmental Disabilities"],"source_url":"https://codes.ohio.gov/ohio-revised-code/section-5126.22","current_through":"2023-04-06 (House Bill 509 - 134th General Assembly)","vintage":"","retrieved_at":"2026-09-14T19:24:39Z","sha256":"e2b157b4f82b04645b9edbb7f7006aabfa381ef191dd321127ff5fe6328547a5","source_id":"us-oh","stale":false,"prev":"us-oh/ohio-rev.-code-5126.21","next":"us-oh/ohio-rev.-code-5126.221"},"notice":"GroundRules: Original legal text.
