Code § 5168.52","heading":"Additional sanctions for past due fee installment.","body":"(A) In addition to assessing a penalty pursuant to section 5168.51 of the Revised Code, the department of medicaid may do any of the following if a nursing facility or hospital fails to pay the full amount of a franchise permit fee installment when due:\n(1) Withhold an amount less than or equal to the installment and penalty assessed under section 5168.51 of the Revised Code from a medicaid payment due the nursing facility or hospital until the nursing facility or hospital pays the installment and penalty;\n(2) Offset an amount less than or equal to the installment and penalty assessed under section 5168.51 of the Revised Code from a medicaid payment due the nursing facility or hospital;\n(3) Terminate the nursing facility or hospital's medicaid provider agreement.\n(B) The department may offset a medicaid payment under division (A) of this section without providing notice to the nursing facility or hospital and without conducting an adjudication under Chapter 119. of the Revised Code.","path":["Title 51 Public Welfare","Chapter 5168 Hospital Care Assurance Program; Health Care Franchise Permit Fees"],"source_url":"https://codes.ohio.gov/ohio-revised-code/section-5168.52","current_through":"2013-09-29 (House Bill 59 - 130th General Assembly)","vintage":"","retrieved_at":"2026-09-14T19:24:40Z","sha256":"c6a343c978f6d283ea44a26efcaa4bbada48de84adea6457e2cd85b1c23e304a","source_id":"us-oh","stale":false,"prev":"us-oh/ohio-rev.-code-5168.51","next":"us-oh/ohio-rev.-code-5168.53"},"notice":"GroundRules: Original legal text.
