Code § 5810.01","heading":"Breach of trust defined - judicial remedies.","body":"(A) A violation by a trustee of a duty the trustee owes to a beneficiary is a breach of trust.\n(B) To remedy a breach of trust that has occurred or may occur, the court may do any of the following:\n(1) Compel the trustee to perform the trustee's duties;\n(2) Enjoin the trustee from committing a breach of trust;\n(3) Compel the trustee to redress a breach of trust by paying money, restoring property, or other means;\n(4) Order a trustee to account;\n(5) Appoint a special fiduciary to take possession of the trust property and administer the trust;\n(6) Suspend the trustee;\n(7) Remove the trustee as provided in section 5807.06 of the Revised Code;\n(8) Reduce or deny compensation to the trustee;\n(9) Subject to section 5810.12 of the Revised Code, void an act of the trustee, impose a lien or a constructive trust on trust property, or trace trust property wrongfully disposed of and recover the property or its proceeds;\n(10) Order any other appropriate relief.","path":["Title 58 Trusts","Chapter 5810 Breach Of Trust"],"source_url":"https://codes.ohio.gov/ohio-revised-code/section-5810.01","current_through":"2007-01-01 (House Bill 416 - 126th General Assembly)","vintage":"","retrieved_at":"2026-09-14T19:24:42Z","sha256":"ed059a022c05901f70225300bcd99dd55d5e40e85fddef96e5f7d670119e729c","source_id":"us-oh","stale":false,"prev":"us-oh/ohio-rev.-code-5809.08","next":"us-oh/ohio-rev.-code-5810.02"},"notice":"GroundRules: Original legal text.
