Code § 5810.12","heading":"Person assisting or dealing with trustee in good faith.","body":"(A) A person other than a beneficiary who in good faith assists a trustee, or who in good faith and for value deals with a trustee, without knowledge that the trustee is exceeding or improperly exercising the trustee's powers is protected from liability as if the trustee properly exercised the power.\n(B) A person other than a beneficiary who in good faith deals with a trustee is not required to inquire into the extent of the trustee's powers or the propriety of their exercise.\n(C) A person who in good faith delivers assets to a trustee is not required to ensure their proper application.\n(D) A person other than a beneficiary who in good faith assists a former trustee, or who in good faith and for value deals with a former trustee, without knowledge that the trusteeship has terminated is protected from liability as if the former trustee were still a trustee.\n(E) Comparable protective provisions of other laws relating to commercial transactions or transfer of securities by fiduciaries prevail over the protection provided by this section.","path":["Title 58 Trusts","Chapter 5810 Breach Of Trust"],"source_url":"https://codes.ohio.gov/ohio-revised-code/section-5810.12","current_through":"2007-01-01 (House Bill 416 - 126th General Assembly)","vintage":"","retrieved_at":"2026-09-14T19:24:42Z","sha256":"e3c584eb05ffa8358dfb8e9b100a4b63c1b737d6ab25e3bf8bf138659e7a69e7","source_id":"us-oh","stale":false,"prev":"us-oh/ohio-rev.-code-5810.11","next":"us-oh/ohio-rev.-code-5810.13"},"notice":"GroundRules: Original legal text.
