Code § 6131.30","heading":"Appeal procedure in common pleas court.","body":"(A) The court of common pleas, on appeal, shall hear the matters appealed de novo. The court, exercising equitable jurisdiction, shall bring the entire proceedings before it in order to determine all the issues raised in the proceedings and enter a final judgment, order, or decree for or against the improvement petitioned for and for or against the assessments to be levied and the compensation and damages to be paid.\n(B) If the court orders the county engineer to make a survey and file the engineer's reports, plans, and schedules, the court also shall enter an order for transfer from the general revenue funds of the county to the general drainage improvement fund a sum of not more than twenty-five per cent of the engineer's preliminary estimate.","path":["Title 61 Water Supply-Sanitation-Ditches","Chapter 6131 Single County Drainage Improvements"],"source_url":"https://codes.ohio.gov/ohio-revised-code/section-6131.30","current_through":"2021-03-24 (House Bill 340 - 133rd General Assembly)","vintage":"","retrieved_at":"2026-09-14T19:24:42Z","sha256":"1146d4c76717dbf0656400bc38d39311ccdbc97691e6134bd66d1c459e3d3e02","source_id":"us-oh","stale":false,"prev":"us-oh/ohio-rev.-code-6131.28","next":"us-oh/ohio-rev.-code-6131.31"},"notice":"GroundRules: Original legal text.
