Code § 971.02","heading":"Preferred partition fence for livestock enclosures.","body":"(A) Except as otherwise provided in this section, all fields and enclosures in which livestock are kept or placed and that are bordered by a division line between the adjoining properties of different owners shall be enclosed by a preferred partition fence.\n(B) Nothing in this chapter prevents an owner from building a fence that exceeds the requirements for a preferred partition fence established under this chapter. The owner building such a fence shall pay all additional costs and expenses of building the fence and maintaining it in good repair.\n(C) This section does not apply to either of the following:\n(1) The owners of adjoining properties that enter into an agreement in accordance with section 971.04 of the Revised Code;\n(2) Fences that were constructed prior to the effective date of this section.","path":["Title 9 Agriculture-Animals-Fences","Chapter 971 Fences"],"source_url":"https://codes.ohio.gov/ohio-revised-code/section-971.02","current_through":"2008-09-30 (House Bill 323 - 127th General Assembly)","vintage":"","retrieved_at":"2026-09-14T19:24:28Z","sha256":"2ef3deb9250ccc7fd215b34765ce0f4c7e7d5eb3f44279f4ae4e241310f85a3d","source_id":"us-oh","stale":false,"prev":"us-oh/ohio-rev.-code-971.01","next":"us-oh/ohio-rev.-code-971.03"},"notice":"GroundRules: Original legal text.
