Stat. tit. 1, § 1-43","heading":"Real property purchaser – Retention of abstract","body":"A purchaser of real property shall have the opportunity to\n\nretain possession of the abstract for the property being purchased.\n\nThe purchaser shall be notified about the option to retain\n\npossession at the scheduled closing; however, if a contractual\n\nobligation to a mortgage company requires retention of the abstract\n\nby that mortgage company, then the purchaser shall have an\n\nopportunity to take possession of the abstract upon complete\n\nperformance of the contractual obligations. If a duly licensed\n\nabstract company is holding or storing any base or supplemental\n\nabstract or abstracts or a previously issued owner’s policy of title\n\ninsurance, upon written request from the owner or the authorized\n\nagent of the owner, pursuant to a current transaction, the licensed\n\nabstractor shall release the abstract or abstracts within three (3)\n\nbusiness days of receipt of the written request or, in the case of a\n\ntitle insurance policy, shall release the owner’s policy pursuant to\n\nsubsection D of Section 5001 of Title 36 of the Oklahoma Statutes.\n\nAll licensed abstractors and certificate of authority holders who\n\nrefuse to do so shall be subject to the following:\n\n1. A civil penalty to the requesting party not less than Two\n\nHundred Fifty Dollars ($250.00) nor more than Two Thousand Dollars\n\n($2,000.00) for each occurrence;\n\n2. Liability in any action for damages, loss or injury suffered\n\nor incurred by any person by reason of failure to deliver the\n\nabstract pursuant to the provisions of this section. Any civil\n\njudgment rendered pursuant to this paragraph may be enforced in the\n\nsame manner in which other civil judgments may be enforced; and\n\n3.
