In any investigation relating to the functions of the Child\n\nDeath Review Board pursuant to Section 1150.2 of Title 10 of the\n\nOklahoma Statutes, the Director of the Oklahoma Commission on\n\nChildren and Youth, if recommended and approved by the Child Death\n\nReview Board and the legal counsel for the Governor, may require the\n\nproduction of, by subpoena, any records, including books, papers,\n\ndocuments, and other tangible things which constitute or contain\n\nevidence which the Board finds relevant or material to the\n\ninvestigation, if the Board has been unable to obtain the necessary\n\ninformation by requesting it. The production of records may be\n\nrequired from any place in the state to be forwarded to the Child\n\nDeath Review Board. Reasonable copying fees shall be paid upon\n\nrequest.\n\nB. Compliance with the subpoena may be accomplished by:\n\n1. Producing documents, as requested; or\n\n2. Notifying the Board, in writing, of refusal to produce\n\ndocuments, within ten (10) days of the date of service.\n\nThe subpoena form shall clearly set forth the optional means of\n\ncompliance including instructions for sending written notice of\n\nrefusal.\n\nC. A subpoena issued pursuant to this section may be served by\n\nany person designated in the subpoena to serve it. Service upon a\n\nnatural person may be made by personal delivery of the subpoena to\n\nthe person. Service may be made upon a domestic or foreign\n\ncorporation or upon a partnership or other unincorporated\n\nassociation which is subject to suit under a common name, by\n\ndelivering the subpoena to an officer, to a managing or general\n\nagent, or to any other agent authorized by appointment or by law to\n\nreceive service of process. The affidavit of the person serving the\n\nsubpoena entered on a true copy thereof by the person serving it\n\nshall be proof of service.\n\nD. In the case of refusal to obey a subpoena issued to any\n\nperson, the Director of the Oklahoma Commission on Children and\n\nYouth may invoke the aid of any district court of the state within\n\nthe jurisdiction of which the investigation is carried on or of\n\nwhich the subpoenaed person is an inhabitant, or in which such\n\nperson conducts business or may be found, to compel compliance with\n\nthe subpoena. The court may issue an order requiring the subpoenaed\n\nperson to appear before the Director to produce records, if so\n\nordered. Any failure to obey the order of the court may be punished\n\nby the court as an indirect contempt thereof. All process in any\n\nsuch case may be served in any judicial district in which such\n\nperson may be found.\n\nE.
