Stat. tit. 10, § 10-1408","heading":"Definitions","body":"A. \"Individual with intellectual disability\" as used in\n\nSections 1406 through 1424 of this title means a person who has\n\nsignificantly subaverage functioning, intelligence quotient of less\n\nthan seventy (70), manifested before the age of eighteen (18) and\n\nexisting concurrently with related limitations in two or more of the\n\nfollowing applicable adaptive skill areas:\n\n1. Communication;\n\n2. Self-care;\n\n3. Home living;\n\n4. Social skills;\n\n5. Use of community resources;\n\n6. Self-direction;\n\n7. Health and safety;\n\n8. Functional academics;\n\n9. Leisure; and\n\n10. Work.\n\nB. \"Resident\" as used in Sections 1406 through 1424 of this\n\ntitle shall mean a person admitted to and in residence in any of the\n\ninstitutions named in Section 1406 of this title, or on a vacation\n\nor extended vacation status from such institution.\n\nC. \"Developmental disability\" as used in Sections 1406 through\n\n1424 of this title means a severe, chronic disability of a person\n\nwhich:\n\n1. Is attributable to a mental or physical impairment or\n\ncombination of mental and physical impairments, such as intellectual\n\ndevelopmental disorder, cerebral palsy, or autism;\n\n2. Is manifested before the person attains twenty-two (22)\n\nyears of age;\n\n3. Is likely to continue indefinitely;\n\n4. Results in substantial functional limitations in three or\n\nmore of the following areas of major life activity:\n\na. self-care,\n\nb. receptive and expressive language,\n\nc. learning,\n\nd. mobility,\n\ne. self-direction,\n\nf. capacity for independent living, and\n\ng. economic self-sufficiency; and\n\n5. Reflects the person's need for a combination and sequence of\n\nspecial, interdisciplinary, or generic care, treatment, or other\n\nservices which are of lifelong or extended duration and are\n\nindividually planned and coordinated. The term developmental\n\ndisability shall not include mentally ill persons, as those persons\n\nare defined by Section 1-103 of Title 43A of the Oklahoma Statutes,\n\nwhose sole disability is mental illness.\n\nD. Nothing in subsection C of this section shall be construed\n\nto render persons who are receiving services upon September 1, 1991,\n\nthrough programs and services for individuals with intellectual\n\ndisabilities offered by the Department of Human Services as\n\nineligible for such services.
