Stat. tit. 10, § 10-1411","heading":"Rules and regulations - Repair of buildings - Federal","body":"funds - Superintendents and other personnel - Expenditure of funds.\n\n(a) The Director of Human Services is authorized and directed\n\nto promulgate and adopt all rules and regulations necessary to carry\n\nout the provisions of Section 1406 et seq. of this title.\n\n(b) The Director shall establish and maintain such methods of\n\nadministration (including methods relating to the establishment and\n\nmaintenance of personnel standards on a merit basis) as are\n\nnecessary for the proper and efficient administration of the\n\nprograms and institutions named in Section 1406 of this title; shall\n\nmaintain records and prepare reports; shall prescribe a uniform\n\naccounting system; and shall exercise any other powers necessary to\n\ncarry out the provisions of Section 1406 et seq. of this title.\n\n(c) The Director may provide for the repair, alterations, or\n\nremodeling of any existing building at the above-named institutions,\n\nor at any other institution under its jurisdiction, necessary for\n\nthe proper and efficient administration and to conserve the\n\nproperties and the state's investment in such properties. Funds\n\navailable for operating expenses and revolving funds of institutions\n\nunder the control of the Department may be used for such purposes,\n\nand may also be expended for land and other capital outlay, whenever\n\nthe Department finds the same is needed for the proper discharge of\n\nits responsibilities. Any county may convey to the State of\n\nOklahoma, for the use of any such institution, land owned but not\n\nneeded by the county; and such conveyance may be made without\n\nconsideration, appraisal, advertisement for bids, or offer to the\n\nhighest bidder, if the board of county commissioners determines that\n\nthe same will not be to the detriment of the county.\n\n(d) The Department is authorized to receive grants of federal\n\nfunds for the purpose of combating or preventing intellectual\n\ndisabilities, including but not limited to funds for the treatment,\n\ncare, rehabilitation, or training of individuals with intellectual\n\ndisabilities, or for the establishment or expansion of any programs\n\nor facilities or research projects relating to individuals with\n\nintellectual disabilities, or for construction of research centers\n\nand facilities for individuals with intellectual disabilities, and\n\nis authorized to cooperate in any reasonable manner with the federal\n\nagency or agencies granting such federal funds for such purposes,\n\nincluding compliance with any conditions prescribed by federal\n\nauthorities for the granting of such funds. The Department may\n\nserve as the sole designated state agency for receiving, disbursing,\n\nor administering federal funds for any of the aforesaid purposes,\n\nprovided federal law requires such an agency and the Department is\n\neligible to be such an agency under federal law. Provided, however,\n\nthat this section shall not prevent any other agency from receiving,\n\ndisbursing, or administering federal grants for any of the aforesaid\n\npurposes, if authorized or required by federal law.\n\n(e) The Department shall establish the duties and fix the\n\ncompensation of the superintendent and other personnel needed at\n\neach of the institutions referred to in Section 1406 of this title.\n\nAppointments to all such positions shall be made by the Director.\n\n(f) The Director shall have authority to provide for the\n\nexpenditure of all funds for the administration and operations of\n\nthe institutions specified in Section 1406 of this title and for a\n\ncompliance with the provisions of Section 1406 et seq. of this\n\ntitle.","path":["OK Code","Title 10"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os10.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"d97da2452c5ecc274f7229c07915688b0f40b88fc6b48dbeeaaa54657eaa08a6","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-10-10-1410","next":"us-ok/okla.-stat.-tit.-10-10-1411.1"},"notice":"GroundRules: Original legal text.
