Stat. tit. 10, § 10-1415.1","heading":"Clinical records - Ombudsman program - Periodic","body":"evaluation - Residential placement - Reports of psychotropic\n\nmedications.\n\nA. 1. All institutions named in Section 1406 of this title\n\nwithin the Department of Human Services, which are established\n\nprimarily for the purpose of caring for individuals with\n\nintellectual disabilities, shall maintain an adequate clinical\n\nrecord of each resident. Such record shall contain initial social,\n\npsychological, and medical evaluation results, as well as interval\n\nreports of the resident's condition, the treatment and training\n\nprescribed, and the progress shown.\n\n2. The Director of Human Services shall establish an ombudsman\n\nprogram for each of the institutions and residential facilities for\n\nindividuals with intellectual disabilities operated by the\n\nDepartment, which shall include, but not be limited to, an appeals\n\nprocedure for the resolution of grievances or complaints of the\n\nresidents of the institutions and facilities and the grievances or\n\ncomplaints of the parents or the court-appointed guardians of the\n\nresidents.\n\nB. The educational and physical capabilities of each resident\n\nshall be assessed at least one time each year by appropriate\n\nprofessional personnel for the purpose of determining such further\n\ntreatment or training as may be required. A report of the findings\n\nand recommendations of such assessments shall be filed in the\n\nclinical record of the resident. Failure on the part of the\n\nsuperintendent of the institution to institute a policy of annual\n\nevaluations, if sufficient personnel are available, shall constitute\n\ndereliction of duty.\n\nC. When annual evaluations of a resident reflect improvement in\n\nsocial or physical capabilities sufficient enough to permit the\n\nresident to be released from the institution, either completely or\n\nconditionally, the superintendent shall return such resident to the\n\nresident's immediate family, or shall provide assistance for the\n\nplacement of the resident in some other appropriate residential\n\nsetting.\n\nD. 1. The Department of Human Services may enter into\n\ncontracts for the development of residential settings and attendant\n\ncommunity services prior to the release of the resident.\n\n2. The Department shall establish procedures which specify the\n\nconditions and requirements for recipients of such contracts. In\n\nestablishing reimbursement rates for recipients of such contracts,\n\nthe Department may take into consideration any unusual or increased\n\ncosts of the recipient relating to the care and treatment of clients\n\nwith developmental disabilities including, but not limited to,\n\nworkers' compensation costs.\n\n3. A copy of these procedures shall be made available to any\n\nperson upon request.\n\nE. 1. In addition to any other form of assistance provided,\n\nthe Department is authorized to pay stipends to eligible relatives\n\nand certified volunteers for the sole purpose of acquiring legal\n\nrepresentation to initiate guardianship proceedings.\n\n2. Financial guidelines and other criteria pertaining to\n\neligibility of relatives and certified volunteers applying for a\n\nstipend shall be established by rules promulgated by the Director.\n\nF. Reports of the reviews of the administration of psychotropic\n\nmedications shall be made available to the parent or the court-\n\nappointed guardian of a resident of the institutions.
