The Commission for Rehabilitation Services shall establish\n\nand maintain such methods of administration, including methods\n\nrelating to the establishment and maintenance of personnel\n\nstandards, as are necessary for the proper and efficient\n\nadministration of the Oklahoma School for the Blind and the Oklahoma\n\nSchool for the Deaf, and programs thereat; shall maintain records\n\nand reports, shall provide a uniform accounting system; and shall\n\nincur such expenses and make such expenditures as it deems necessary\n\nto maintain and operate such schools.\n\nB. 1. Instructional Personnel. The Director of the State\n\nDepartment of Rehabilitation Services shall employ or contract with\n\nsuch qualified instructional personnel including, but not limited\n\nto, teachers, and such other persons serving in an instructional\n\ncapacity, as the director deems necessary for the proper operation\n\nof each school and shall fix their duties and compensation. The\n\nsuperintendent, teachers and other employees shall be eligible for\n\nmembership or participation in the Teachers' Retirement System of\n\nOklahoma to the same extent and on the same basis as teachers and\n\nother employees of other state educational institutions and public\n\nschools. The Director shall not employ or contract with a person as\n\ninstructional personnel unless the superintendent of the school has\n\nrecommended that person. If there is a vacancy in the\n\nsuperintendent position or if the superintendent is unable to make a\n\nrecommendation within thirty (30) days after a request for a\n\nrecommendation is made, the Director is authorized to employ or\n\ncontract with any person without a recommendation from the\n\nsuperintendent.\n\n2. Career Teacher. A career teacher is a member of the\n\ninstructional staff who has served in an instructional capacity for\n\nthree (3) or more consecutive years in either school, or who has\n\nserved in a public school district in such a way so as to meet the\n\ndefinition of a career teacher as provided for in Section 6-101.3 of\n\nTitle 70 of the Oklahoma Statutes. Career teacher shall not include\n\na school nurse.\n\n3. Probationary Teacher. A probationary teacher is a member of\n\nthe instructional staff who has served in an instructional capacity\n\nfor less than three (3) consecutive years in either school, or who\n\nhas served in a public school district in such a way so as to meet\n\nthe definition of a probationary teacher as provided for in Section\n\n6-101.3 of Title 70 of the Oklahoma Statutes.\n\nC. Administrative Personnel.\n\n1. The Director of the State Department of Rehabilitation\n\nServices shall employ or appoint the superintendent of each school\n\nand shall fix their duties and compensation. The superintendents\n\nshall be in the unclassified service.\n\n2. The Director of the State Department of Rehabilitation\n\nServices shall employ or contract with such other administrative\n\npersonnel as the Director deems necessary for the proper operation\n\nof each school and shall fix their duties and compensation. The\n\nadministrative personnel may include, but is not limited to,\n\nassistant superintendents, principals, vice-principals and other\n\npersons who devote a majority of their time to service in a\n\nsupervisory or administrative capacity.\n\nD. An orientation and mobility specialist employed by the State\n\nDepartment of Rehabilitation Services to serve at the Oklahoma\n\nSchool for the Blind shall be accorded the same protection of laws\n\nand all other benefits accorded instructional personnel, including\n\nbut not limited to, the minimum salary level for instructional\n\npersonnel.\n\nE. 1. The Commission shall, pursuant to the Administrative\n\nProcedures Act, adopt personnel policies for instructional and\n\nadministrative personnel, except for superintendents, that are\n\nconsistent with the law applicable to public school district\n\nemployees, including, but not limited to, leave, payment for unused\nuding\n\nbut not limited to, the minimum salary level for instructional\n\npersonnel.\n\nE. 1. The Commission shall, pursuant to the Administrative\n\nProcedures Act, adopt personnel policies for instructional and\n\nadministrative personnel, except for superintendents, that are\n\nconsistent with the law applicable to public school district\n\nemployees, including, but not limited to, leave, payment for unused\n\npersonal leave and employment policies, evaluation policy, grievance\n\nprocedures, professional development, and a minimum salary schedule.\n\nThe Commission shall initiate a rulemaking process for the personnel\n\npolicies for instructional and administrative personnel no later\n\nthan October 1, 2003. The minimum salary level for qualified\n\ninstructional personnel shall meet or exceed the minimum salary\n\nlevel provided for public school teachers in Section 18-114.14 of\n\nTitle 70 of the Oklahoma Statutes or any additional minimum salary\n\nschedule enacted by the Legislature and the Commission shall meet or\n\nexceed any other legislatively mandated pay raises for teachers that\n\nare not part of the minimum salary schedule. The Department shall\n\nnotify teachers and other personnel on or before the first Monday in\n\nJune of each year concerning the renewal of contracts consistent\n\nwith the requirements for public school teachers as provided for in\n\nSection 6-101 of Title 70 of the Oklahoma Statutes. The policy for\n\nprofessional development programs for instructional and\n\nadministrative personnel shall be consistent with the requirements\n\nfor professional development programs for public school teachers as\n\nprovided in Section 6-194 of Title 70 of the Oklahoma Statutes.\n\n2. Final disciplinary action taken against a member of the\n\ninstructional or administrative staff, except superintendents,\n\nincluding termination or the nonrenewal of a contract, shall be\n\nsubject to the administrative hearing procedures as set forth in\n\nArticle II of the Oklahoma Administrative Procedures Act. If the\n\nfinal decision of the Director is to terminate or to not renew the\n\ncontract of a career teacher or administrator, the career teacher or\n\nadministrator, except superintendent, shall not have a right to\n\njudicial review pursuant to Article II of the Oklahoma\n\nAdministrative Procedures Act, but shall have a right to a trial de\n\nnovo as provided for in Section 1419a of this title. Disciplinary\n\naction against a probationary teacher shall be final unless\n\notherwise provided for by law.\n\nF. The State Department of Education shall insure that any\n\nfunds which have been received in Oklahoma by the State Department\n\nof Education because of students who are enrolled and attending the\n\nOklahoma School for the Blind and the Oklahoma School for the Deaf\n\nare transferred to the State Department of Rehabilitation Services\n\nfor use by these schools in proportion to the number of students\n\nenrolled and attending who were the basis for the receipt of these\n\nfederal funds.\n\nG.
