Stat. tit. 10, § 10-1424","heading":"Department as next friend of institutionalized persons -","body":"Procuring appoint of guardian.\n\nThe State Department of Public Welfare shall have the power and\n\nthe Department shall have the duty to appear as next friend for all\n\nminor orphans, incompetents, dependents and delinquents who are\n\ninmates of any public institution maintained and operated by the\n\nstate, county, city or municipality before the district court having\n\nprobate jurisdiction, and ask that legal guardians be appointed for\n\nthe estates of such minor orphans, incompetents, dependents and\n\ndelinquents when it appears that such persons have an interest in\n\nsome estate, legacy, or property, and shall have such power and\n\nauthority in any and all litigation where interests of such persons\n\nmay require to be prosecuted or defended or instituted in any and\n\nall courts in this state.\n\nThe State Department of Public Welfare, in addition to the\n\nforegoing, is hereby empowered to intervene as next friend in cases\n\nof all minor orphans in this state when it is shown or appears to\n\nthe Department that the estate of such minors is being mismanaged or\n\ndishonestly administered.","path":["OK Code","Title 10"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os10.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"076d49e65cce6dea1efeef137e716e318fce26994fc245d401f5819de1d830af","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-10-10-1423","next":"us-ok/okla.-stat.-tit.-10-10-1425"},"notice":"GroundRules: Original legal text.
