Stat. tit. 10, § 10-1430.14","heading":"Provisions of license - Application - Statement of","body":"zoning compliance - Qualifications of applicant or licensee -\n\nStatement of ownership - Issuance and renewal of licenses.\n\nA. A license shall expire twelve (12) months from the date of\n\nissuance, unless sooner revoked, and may be renewed annually by the\n\nDepartment of Human Services pursuant to the provisions of the Group\n\nHomes for Persons with Developmental or Physical Disabilities Act.\n\nAll licenses shall be on a form prescribed by the Director of Human\n\nServices, and shall include, but not be limited to, the maximum bed\n\ncapacity for which the license is granted, the kind of program the\n\nlicensee is certified to operate, the date the license was issued,\n\nand the expiration date of the license. The provisions of the\n\nlicense shall require that the license shall:\n\n1. Not be transferable or assignable except as authorized by\n\nthe provisions of the Group Homes for Persons with Developmental or\n\nPhysical Disabilities Act;\n\n2. Be available on the licensed premises; and\n\n3. Be issued only for the premises named in the application,\n\nand may be renewed for twelve-month periods upon application and\n\ninspection, pursuant to the provisions of the Group Homes for\n\nPersons with Developmental or Physical Disabilities Act.\n\nB. An application shall be under oath and shall contain, but\n\nnot be limited to, the following information:\n\n1. The name and address of the applicant or licensee. If the\n\napplicant or licensee is a firm or partnership, the name and address\n\nof each member thereof shall be included in the application. If the\n\napplicant or licensee is a firm, partnership, limited liability\n\ncompany, or corporation, the name and address of the firm,\n\npartnership, limited liability company, or corporation and the name\n\nand address of each member of the firm, major member of the limited\n\nliability company or manager, major partner of the partnership, or\n\nofficer, major stockholder and registered agent of the corporation\n\nshall be included in the application;\n\n2. The name and address of the applicant or licensee if the\n\napplicant or licensee is not the provider and is acting as agent for\n\nthe provider of group home services or licensee;\n\n3. The name and location of the group home for which a license\n\nis sought;\n\n4. The name of the administrator of the home;\n\n5. The number and type of residents for whom services are to be\n\nprovided;\n\n6. A description of the program and the staffing pattern for\n\nproviding resident care. In the case of an application for an\n\ninitial license, such description may be shown as the projected\n\nprogram and staffing pattern; and\n\n7. Information or records required by the Department pursuant\n\nto the rules adopted by the Commission for Human Services regarding\n\ngroup homes.\n\nC. Each initial application shall be accompanied by a statement\n\nfrom the unit of local government having zoning jurisdiction over\n\nthe location of the group home stating that the location is not in\n\nviolation of a zoning ordinance.\n\nD. 1. An applicant or licensee shall be twenty-one (21) years\n\nof age or older and of reputable and responsible character. In\n\naddition, the applicant or licensee shall have appropriate business\n\nor professional experience.\n\n2. No person who is ineligible for employment as a community\n\nservices worker in accordance with Section 1025.2 of Title 56 of the\n\nOklahoma Statutes shall be eligible to be licensed or to receive a\n\ncontract to become a community services provider. If the applicant\n\nor licensee is a firm, partnership, limited liability company, or\n\ncorporation, the applicant shall not be eligible to be licensed or\n\nto receive a contract if any member of the firm, any major member of\n\nthe limited liability company or manager, any major partner of the\n\npartnership, or any officer or major stockholder of the corporation\n\nis ineligible for employment as a community services worker in\ncompany, or\n\ncorporation, the applicant shall not be eligible to be licensed or\n\nto receive a contract if any member of the firm, any major member of\n\nthe limited liability company or manager, any major partner of the\n\npartnership, or any officer or major stockholder of the corporation\n\nis ineligible for employment as a community services worker in\n\naccordance with Section 1025.2 of Title 56 of the Oklahoma Statutes.\n\nE. The application for a license or renewal of a license shall\n\nbe accompanied by a statement of ownership which shall include the\n\nfollowing:\n\n1. The name, address, telephone number, occupation or business\n\nactivity, business address, and business telephone number of the\n\nowner of the group home and of every person who owns the building in\n\nwhich the group home is located. If the owner is a partnership,\n\nlimited liability company, or corporation, the name and address of\n\neach partner, major member of the limited liability company, and\n\nstockholder with an ownership interest of five percent (5%) or more\n\nshall be included in the statement; and\n\n2. The name and address of any other group home in which the\n\nowner has a full or partial financial interest or, if the applicant\n\nor licensee is a partnership, limited liability company, or\n\ncorporation, any other group home in which the partnership, limited\n\nliability company, or corporation has a full or partial financial\n\ninterest. The statement shall indicate whether or not any other\n\ngroup home wherein a full or partial financial interest is held\n\nwould, if located in this state, be required to be licensed.\n\nF.
