A license to operate a group home subject to the provisions\n\nof the Group Homes for Persons with Developmental or Physical\n\nDisabilities Act is not transferable. Operation of a group home can\n\nonly be transferred:\n\n1. With the prior written approval of the director of the\n\nDevelopmental Disabilities Services Division (DDSD) of the\n\nDepartment of Human Services or designee; and\n\n2. From the provider or licensee named in the application to\n\nanother provider who has a current license or is deemed licensed in\n\naccordance with Section 1430.3 of this title.\n\nB. The transferor shall remain responsible for the operation of\n\nthe group home until the transfer is complete. The transferor shall\n\nremain liable for all penalties assessed which are imposed for\n\nviolations occurring prior to transfer of operation.
