Stat. tit. 10, § 10-1430.2","heading":"Definitions","body":"As used in the Group Homes for Persons with Developmental or\n\nPhysical Disabilities Act:\n\n1. \"Abuse\" as defined by the Protective Services for Vulnerable\n\nAdults Act means causing or permitting:\n\na. the infliction of physical pain, injury, sexual abuse,\n\nsexual exploitation, unreasonable restraint or\n\nconfinement, or mental anguish, or\n\nb. the deprivation of nutrition, clothing, shelter,\n\nhealth care, or other care or services without which\n\nserious physical or mental injury is likely to occur\n\nto a vulnerable adult by a caretaker or other person\n\nproviding services to a vulnerable adult;\n\n2. \"Access\" means the right of a person to enter a group home\n\nto communicate privately and without unreasonable restriction;\n\n3. \"Administrator\" means the person designated by the provider\n\nwho has authority and responsibility for the programs and operation\n\nof a group home;\n\n4. \"Advisory Board\" means the Group Homes for Persons with\n\nDevelopmental or Physical Disabilities Advisory Board established by\n\nSection 1430.4 of this title;\n\n5. \"Advocate\" means an adult designated in writing selected by\n\nthe resident to assist the resident in exercising the rights of such\n\nresident;\n\n6. \"Applicant\" means a person, corporation, limited liability\n\ncompany, partnership, association, or other entity which is being\n\nconsidered by the Department of Human Services for a license with\n\nthe Department to provide group home services;\n\n7. “Case manager” means a staff member who is responsible for\n\nensuring that services to a resident are planned and provided in a\n\ncoordinated fashion;\n\n8. \"Commission\" means the Commission for Human Services;\n\n9. \"Contract\" means the binding legal agreement to provide\n\ngroup home services, entered into between the provider and the\n\nDevelopmental Disabilities Services Division of the Department of\n\nHuman Services or the Oklahoma Health Care Authority (OHCA);\n\n10. \"DDSD\" means the Developmental Disabilities Services\n\nDivision of the Department of Human Services;\n\n11. \"Department\" means the Department of Human Services;\n\n12. \"Developmental disability\" means a severely chronic\n\ndisability of a person which:\n\na. is attributable to a physical or mental impairment or\n\na combination of physical and mental impairments,\n\nb. is manifested before the person attains the age of\n\ntwenty-two (22) years,\n\nc. is likely to continue indefinitely,\n\nd. results in substantial functional limitations in three\n\nor more of the following areas of major life activity:\n\n(1) self-care,\n\n(2) receptive and expressive language,\n\n(3) learning,\n\n(4) mobility,\n\n(5) self-direction,\n\n(6) capacity for independent living, or\n\n(7) economic self-sufficiency, and\n\ne. reflects the need of the person for a combination and\n\nsequence of special interdisciplinary or generic care,\n\ntreatment or other services which are of lifelong or\n\nextended duration and are individually planned and\n\ncoordinated;\n\n13. \"Director\" means the Director of Human Services;\n\n14. \"Exploitation\" means the unjust or improper use of the\n\nresources of a group home resident for the profit or advantage,\n\npecuniary or otherwise, of a person other than the group home\n\nresident through the use of undue influence, coercion, harassment,\n\nduress, deception, false representation, or false pretense, as\n\ndefined by the Protective Services for Vulnerable Adults Act;\n\n15. \"Group home for persons with developmental or physical\n\ndisabilities\" means any establishment for not more than twelve\n\nresidents who are eighteen (18) years of age or older and who have\n\ndevelopmental or physical disabilities, which offers or provides\n\nsupervision, residential accommodations, food service, and training\n\nand skill development opportunities designed to lead to increased\n\nindependence of the residents and which offers or provides\n\nsupportive assistance to any of its residents requiring supportive\n\nassistance;\n\n16. \"Guardian\" means a court-appointed representative or\n\nconservator;\nor physical disabilities, which offers or provides\n\nsupervision, residential accommodations, food service, and training\n\nand skill development opportunities designed to lead to increased\n\nindependence of the residents and which offers or provides\n\nsupportive assistance to any of its residents requiring supportive\n\nassistance;\n\n16. \"Guardian\" means a court-appointed representative or\n\nconservator;\n\n17. \"Habilitation\" means services designed to assist\n\nindividuals in acquiring, retaining, and improving the self-help,\n\nsocialization, and adaptive skills necessary to reside successfully\n\nin home and community-based settings;\n\n18. \"Home\" or \"group home\" means a group home for persons with\n\ndevelopmental or physical disabilities;\n\n19. “Indecent exposure” means forcing or requiring a resident\n\nto:\n\na. look upon the body or private parts of another person\n\nor look upon sexual acts performed in the presence of\n\nthe resident, or\n\nb. touch or feel the body or private parts of another;\n\n20. \"Licensee\" means a person, corporation, partnership,\n\nlimited liability company, or association who is the operator of a\n\nhome which is licensed pursuant to the provisions of the Group Homes\n\nfor Persons with Developmental or Physical Disabilities Act;\n\n21. \"Neglect\" as defined by the Protective Services for\n\nVulnerable Adults Act means:\n\na. the failure to provide protection for a group home\n\nresident who is unable to protect his or her own\n\ninterests,\n\nb. the failure to provide adequate shelter, nutrition,\n\nhealth care, or clothing, or\n\nc. negligent acts or omissions that result in harm or the\n\nunreasonable risk of harm to a vulnerable adult\n\nthrough the action, inaction, or lack of supervision\n\nby a caretaker providing direct services;\n\n22. \"Physical disability\" means a condition which causes the\n\nrestricted use of the extremities by an individual or affects other\n\nbodily functions of an individual and which requires the specialized\n\ntraining, habilitation or rehabilitation services provided by a\n\ngroup home;\n\n23. “Program coordinator” means a person employed by a provider\n\nor a licensee who is responsible for the supervision, coordination,\n\nand monitoring of services to a resident receiving services provided\n\nby the provider or licensee;\n\n24. \"Provider\" means a person, corporation, partnership,\n\nlimited liability company, association, or other entity that\n\ncontracts with the Developmental Disabilities Services Division of\n\nthe Department of Human Services or the Oklahoma Health Care\n\nAuthority to operate a group home for persons with developmental or\n\nphysical disabilities;\n\n25. \"Resident\" means a person receiving services in a group\n\nhome for persons with developmental or physical disabilities;\n\n26. “Sexual abuse” as defined in the Protective Services for\n\nVulnerable Adults Act means:\n\na. oral, anal, or vaginal penetration of a resident by or\n\nthrough the union with the sexual organ of a caretaker\n\nor other person providing services to the resident, or\n\nthe anal or vaginal penetration of a resident by a\n\ncaretaker or other person providing services to the\n\nresident with any other object,\n\nb. for the purpose of sexual gratification, the touching,\n\nfeeling, or observation of the body or private parts\n\nof a resident by a caretaker or other person providing\n\nservices to the resident, or\n\nc. indecent exposure by a caretaker or other person\n\nproviding services to the resident;\n\n27. “Sexual exploitation” as defined in the Protective Services\n\nfor Vulnerable Adults Act includes, but is not limited to, a\n\ncaretaker causing, allowing, permitting, or encouraging a resident\n\nto engage in prostitution, or in the lewd, obscene, or pornographic\n\nphotographing, filming, or depiction of the resident as those acts\n\nare defined by state law;\n\n28. \"Supervision\" means the provision of on-site staffing in\nation” as defined in the Protective Services\n\nfor Vulnerable Adults Act includes, but is not limited to, a\n\ncaretaker causing, allowing, permitting, or encouraging a resident\n\nto engage in prostitution, or in the lewd, obscene, or pornographic\n\nphotographing, filming, or depiction of the resident as those acts\n\nare defined by state law;\n\n28. \"Supervision\" means the provision of on-site staffing in\n\nthe group home or on the premises of the group home when a resident\n\nis present who requires on-site staffing, as determined by the team\n\nof the resident. Supervision also includes provision of necessary\n\nstaff support, as documented in the individual plan of each service\n\nrecipient, when the service recipient is in the community, except\n\nwhen the service recipient is engaged in employment, vocational\n\nservices, or adult day services;\n\n29. \"Supportive assistance\" means the service rendered to a\n\nservice recipient which is sufficient to enable the service\n\nrecipient to meet an adequate level of daily living. Supportive\n\nassistance includes, but is not limited to, training and supervision\n\nof service recipients, assistance in housekeeping, assistance in the\n\npreparation of meals, and assistance in activities of daily living\n\nas necessary for the health and comfort of service recipients;\n\n30. \"Transfer\" means a change in location of living\n\narrangements of a resident from one group home to another group\n\nhome;\n\n31. “Team” means the group of people responsible for service\n\nplanning, implementation, and monitoring of the individual plan.\n\nThe team includes:\n\na. the person receiving services,\n\nb. the case manager of the person receiving services, if\n\napplicable,\n\nc. the legal guardian of the person receiving services,\n\nif the service recipient has a legal guardian,\n\nd. the advocate(s) of the person receiving services, if\n\nthere is an advocate, who may be a parent, family\n\nmember, friend, or another who knows the service\n\nrecipient well,\n\ne. the program coordinator or designee, and\n\nf. any other person whose participation is necessary to\n\nachieve the outcomes included in the individual plan;\n\nand\n\n32. “Verbal abuse” as defined in the Protective Services for\n\nVulnerable Adults Act means the use of words, sounds, or other\n\ncommunication including, but not limited to, gestures, actions or\n\nbehaviors, by a caretaker or other person providing services to a\n\nresident that is likely to cause a reasonable person to experience\n\nhumiliation, intimidation, fear, shame, or degradation.","path":["OK Code","Title 10"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os10.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"c86c222ad8239496baffe614672efa0e0e636d6c1ce198790511e5f23c64fbf7","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-10-10-1430.19","next":"us-ok/okla.-stat.-tit.-10-10-1430.20"},"notice":"GroundRules: Original legal text.
