Stat. tit. 10, § 10-1430.25","heading":"Involuntary transfer or discharge of resident","body":"A group home subject to the provisions of the Group Homes for\n\nPersons with Developmental or Physical Disabilities Act shall not\n\ninvoluntarily transfer or discharge a resident except for medical\n\nreasons, for the safety of the resident or for the safety of other\n\nresidents, for violations of the contract between the resident and\n\nthe group home or for nonpayment for the stay of the resident.\n\nInvoluntary transfer or discharge of a resident for violations of\n\nthe contract shall be subject to the conditions and procedures\n\nestablished by the rules adopted by the Commission for Human\n\nServices. Involuntary transfer or discharge of a resident from a\n\ngroup home shall be preceded by a minimum written notice of thirty\n\n(30) days. The thirty-day requirement shall not apply in any of the\n\nfollowing instances:\n\n1. When an emergency transfer or discharge is mandated by the\n\nhealth care needs of the resident and is in accordance with the\n\nwritten orders and medical justification of the attending physician;\n\nor\n\n2.
